OFFICIAL RULES

 

The “XBOX Forza Motorsport 7: Take The Lead From James Hinchcliffe” Contest (the “Contest”) is governed by these official rules (the “Official Rules”), which are available online at www.xbox.com/en-ca/promotions/forza-take-the-lead.com from October 17, 2017 at 12:00PM ET until October 29, 2017 at 11:59PM ET.  By participating in the Contest, each entrant agrees to be legally bound by these Official Rules, including without limitation all eligibility requirements, and understands that the Sponsors (defined below) decisions about the Contest are final and binding in all respects. If an individual does not agree to be legally bound by the Official Rules, then he/she should not enter or otherwise participate in the Contest. The Contest is subject to all federal, provincial, territorial and municipal laws and regulations and is void where prohibited by law.

 

The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram or Twitter. Instagram and Twitter are each hereby completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Twitter or Instagram.

SPONSOR:

This Contest is sponsored by Microsoft Canada Inc., 1950 Meadowvale Blvd, Mississauga ON L5N 8L9 (the “Sponsor”).

CONTEST PERIOD:

The entry period for the Contest begins on October 17, 2017 at 12:00PM Eastern Time (“ET”) and ends on October 29, 2017 at 11:59 PM ET (the “Contest Period”).

ELIGIBILITY, RESIDENCY AND AGE:

The Contest is only open to natural persons who (at the time of entry): (i) are residents of and are physically located in Canada; and (ii) have reached the legal age of majority in their province/territory of residence and have valid government issued photo identification for verification purposes (HOWEVER, as noted below in section 6, in order to participate in the Tour “defined below”, the confirmed winner must be twenty-one (21) years of age or older and must have a valid drivers license – see section 6 below for details). Employees, representatives or agents (and those with whom such persons are living, whether related or not) of Sponsor, Microsoft Canada (the “Contest Administrator”), their respective parent companies, subsidiaries, affiliates, associated companies, prize suppliers, advertising/contest agencies and any other individual or entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”) are not eligible to enter or win.

HOW TO ENTER:

NO PURCHASE NECESSARY.  In order to enter the Contest, eligible entrants must first play “Forza Motorsport 7” (the “Game”) (please see the Important Note below regarding the options available to entrants to access and play the Game) and record a faster race time (a “Faster Time”) than the Set Time (defined below) on the Race Track (defined below) during the Contest Period, and take a “selfie” photo of yourself and your Faster Time (a “Photo”).

  • Number of Race Laps: 2
  • Set Time: 5:46:653 (the “Set Time”)

 

Once you have taken a Photo of your Faster Time, there are two (2) ways to enter the Contest, respectively as follows:

 

  1. INSTAGRAM: If you login to your personal Instagram account (an “Instagram Account”) and post your Photo (which for greater certainty, must clearly show your face and your personal Faster Time) with the hashtag #TakeTheLeadContest (the “Hashtag”) and mention @Xbox Canada during the Contest Period (as determined by the Sponsor in its sole and absolute discretion), you will receive one (1) entry (an “Instagram Entry”). Your Instagram Account settings must be public such that the Sponsor is able to detect your participation in this Contest and communicate with you in order to administer the Contest (including following Xbox Canada on Instagram such that the Sponsor may send you direct messages on Instagram). If you do not have an Instagram Account, visit www.instagram.com and follow the on-screen instructions to sign up for free.
  2. TWITTER: If you login to your personal Twitter account (a “Twitter Account”) and post your Photo (which for greater certainty, must clearly show your face and your personal Faster Time) with the Hashtag and mention @Xbox Canada during the Contest Period (as determined by the Sponsor in its sole and absolute discretion), you will receive one (1) entry (a “Twitter Entry”). Your Twitter Account settings must be public such that the Sponsor is able to detect your participation in this Contest and communicate with you in order to administer the Contest (including following Xbox Canada on Twitter such that the Sponsor may send you direct messages on Twitter). If you do not have a Twitter Account, visit www.twitter.com and follow the on-screen instructions to sign up for free.

Collectively, Instagram Entries and Twitter Entries will be referred to as “Entries”. Collectively, Instagram Accounts and Twitter Accounts will be referred to as “Accounts”.

 

Important Note: There are three (3) ways eligible entrants can access the Game, respectively as follows:

 

  1. Download a free demo of the Game by following the on-screen instructions on the Xbox dashboard on an Xbox Console or on PC from the Microsoft store - https://www.microsoft.com/en-ca/store/p/forza-motorsport-7-demo/9p2xh29364lh
  2. Purchase the full version of the Game for either Xbox Console or PC.

 

  • Visit one of the two (2) live free demo stations (each, a “Station”), which are respectively taking place in the following cities at the following locations and times:

The Released Parties (defined below) will be in no way responsible in the event that a planned Station is delayed, cancelled, postponed or rescheduled for any reason whatsoever.

LIMITS AND VERIFICATION:

There is a limit of one (1) Twitter Entry per person/Twitter Account per Day (a “Day” is defined as beginning at 12:00:01 AM ET and ending at 11:59:59 PM ET) and a corresponding limit of thirteen (13) Twitter Entries per person/Twitter Account per throughout the Contest Period. There is a limit of one (1) Instagram Entry per person/Instagram Account per Day and a corresponding limit of thirteen (13) Instagram Entries per person/ Instagram Account per throughout the Contest Period. There it a total maximum limit of twenty-six (26) Entries per person throughout the Contest Period (regardless of the Account(s) used to enter the Contest).

Incomplete Entries will be disqualified. All Entries become the sole property of the Sponsor and receipt of Entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, mutilated, invalid, unintelligible, or misdirected Entries; all such Entries will be disqualified (as determined by the Sponsor in its sole and absolute discretion).

If it is discovered that you have attempted to: (i) exceed any of the limits stated in the Official Rules; or (ii) use more than one (1) Twitter Account and/or Instagram Account to enter, or otherwise participate in, the Contest then (in the sole and absolute discretion of the Sponsor), you may be disqualified from the Contest and all your Entries are subject to disqualification by the Sponsor. Your Entry will be rejected if (in the sole and absolute discretion of the Sponsor) the entry form is not fully completed and submitted in accordance with these Official Rules during the Contest Period.  Use of any automated, script, macro, robotic or other program(s) to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification by the Sponsor. All entrants and Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity, eligibility and/or compliance with any provision of these Official Rules (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof to the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion). The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s). All decisions of the Sponsor are final and binding.

PRIZE:

There is one (1) Prize; however, the Prize available to be won will depend on the confirmed winners age, as follows:

IF THE CONFIRMED PRIZE WINNER IS TWENTY-ONE (21) YEARS OF AGE OR OLDER: The Prize consists of the winner having the opportunity to participate in a 4 day Porsche Performance Tour of British Columbia (including certain meals and accommodations) (the “Tour”). The Tour includes: (i) round-trip economy airfare for the winner from the major Canadian airport nearest to the winners residence (as determined by the Sponsor in its sole and absolute discretion); (ii) overnight accommodation the day prior to the Tour beginning and (ii) the opportunity to participate in one (1) of the three (3) May/June 2018 tours (subject to availability). Total approximate retail value of the Tour is $6,500 CAD based on a Toronto hypothetical departure example. Without limiting the generality of the foregoing, the following terms and conditions apply to the Tour: (i) the Tour must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions except at Sponsors option; (iii) all travel related to the Tour must be completed on the dates specified by the Sponsor in its sole and absolute discretion based on the tour dates (otherwise the Tour will be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the confirmed winner must have all necessary documentation to permit travel; (v) the costs of everything not specifically and expressly stated above as included in the Tour are the sole and absolute responsibility of the confirmed winner, including, without limitation: transportation for the confirmed winner to and from the Canadian departure airport; excess baggage and other fees; and items of a personal nature (NOTE: the confirmed winner may be required to present a valid major credit card in his/her name at the time of hotel check-in(s) to cover any incidental expenses); (vi) if the confirmed winner does not utilize any part(s) of the Tour, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Tour or any component thereof; and (b) substitute the Tour or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsors sole discretion, a cash award; (viii) all travel arrangements relating to the Tour must be made through the Sponsor or its designated agents; (ix) by accepting the Tour, the confirmed winner agrees to waive all recourse against the Released Parties if the Tour or a component thereof does not prove satisfactory, either in whole or in part; (x) neither Sponsor nor any of its prize suppliers will replace any lost or stolen tickets; (xi) the confirmed winner must: (a) hold a valid drivers license (as required to participate in the tour and subject to the Tour providers review and approval); and (b) sign all documentation required by the Tour provider to participate in the tour, including without limitation the Porsche Driving Experience Waiver  and a vehicle use agreement; (xii) any difference between the actual value of the Tour and its stated approximate retail value will not be awarded; (xiii) all characteristics and features of the Tour (and of each Tour element), except as otherwise explicitly stated above, are at the Sponsors sole and absolute discretion; (xiv) precise travel arrangements are subject to space and flight availability and shall be made at the Sponsors sole and absolute discretion; (xv) once booked, travel and tour arrangements may not be changed by the Tour winner; (xv) the Released Parties will be in no way responsible in the event that any part of the Tour is delayed, cancelled, postponed or rescheduled for any reason whatsoever; (xvi) in the event that the winner resides within a 250km radius of Vancouver (as determined by Sponsor in its sole and absolute discretion), the Tour will not include airline travel or other transportation to and from Vancouver and no alternative prizing will be provided; and (xvii) the confirmed winner will be required to sign and return a declaration and release form.  

IF THE CONFIRMED PRIZE WINNER IS UNDER TWENTY-ONE (21) YEARS OF AGE, BUT HAS REACHED THE LEGAL AGE OF MAJORITY: The Prize will consists of $6,500 CAD awarded in the form of a cheque (“Cash”). The Cash must be accepted as awarded. The Cash is non-transferable, and cannot be substituted for another prize.

Notwithstanding the foregoing, Sponsor reserves the right (at its sole and absolute discretion) to substitute the Prize, or any component thereof, for another prize of equal or greater value in the event the Prize, or any component thereof, is unavailable or for any other reason whatsoever. All characteristics and features of the Prize (except as otherwise explicitly described above) will be determined by the Sponsor in its sole and absolute discretion.

 

PRIZE WINNER SELECTION:

A random draw will take place on Wednesday November 1, 2017 at 12:00 PM noon ET at 2700 Matheson Blvd. E, Mississauga, ON from all eligible Entries received throughout the Contest Period to select the potential Prize winner. The odds of winning the Prize will depend on the total number of eligible Entries received throughout the Contest Period.

NOTIFICATION AND CONFIRMATION OF PRIZE WINNER:

Potential winner will be contacted within three (3) business days of the draw by the Sponsor or its representatives. Each entrant is solely responsible for monitoring his/her Account(s) for such notification message(s). If the potential winner cannot be reached, does not accept the Prize or fails to comply with these Official Rules and requirements within three (3) days of being contacted by the Sponsor or its representative (all as determined by Sponsor in its sole and absolute discretion), such potential winner will be disqualified and will forfeit all rights to the Prize. Upon such forfeiture, no compensation will be given to such disqualified potential winner and Sponsor will have sole discretion to randomly select another winner from the remaining Entries received during the Contest Period (and, in such event, the notification and confirmation provisions stated in these Official Rules will apply to such new potential winner, with the necessary amendments).

Before being declared the Prize winner, the potential winner will be required to correctly answer a mathematical skill-testing question, without aid or assistance, will be required to provide valid government issued photo identification and will also be required to sign a Declaration of Eligibility, General Liability and Publicity Release (within the timeline specified by the Sponsor) pursuant to which the potential winner, among other things, accepts the Prize as awarded and fully releases the Contest Parties and their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from all liability in connection with this Contest and the awarding and use or misuse of the Prize.   Failure by a potential winner to sign and return the requested documents (including without limitation the Declaration of Eligibility, General Liability and Publicity Release) or comply with any terms in these Official Rules (as determined by the Sponsor in its sole and absolute discretion) may disqualify such potential winner and, if disqualified, such winner will forfeit all rights to the Prize. If a potential winner fails to correctly answer the skill-testing question, such potential winner will be deemed ineligible and will forfeit all rights to the Prize. In the event of any such forfeiture, Sponsor will have sole discretion to randomly select another winner from the remaining Entries received during the Contest Period (and, in such event, the notification and confirmation provisions stated in these Official Rules will apply to such new potential winner, with the necessary amendments). 

GENERAL CONDITIONS:

Without limiting the generality of any other provision of these Official Rules, by entering the Contest, each participant agree to indemnify, release and hold harmless the Released Parties from any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, participation in this Contest, or possession, acceptance and/or use or misuse of the Prize (if applicable)  or participation in any Contest-related activity and/or claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.

ADDITIONAL TERMS:

The Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable social media platform, network connections, third party apps, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of Entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, which  may occur in relation to this Contest including any injury or damage to an entrants or any other person's computer or mobile device related to or resulting from downloading any material connected to the Contest. The Released Parties are not responsible for any errors or omissions in printing or advertising this Contest. The Released Parties are not responsible for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due Contest related documents or prize notifications.

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest in accordance with the letter and spirit of these Official Rules.  Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

Sponsor reserves the right (subject only to the consent of the Régie des alcools, des course et des jeux in Québec (the “Régie”), if required by law) to withdraw, amend or suspend this Contest (or to amend these Official Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules.  Sponsor (subject only to the consent of the Régie in Québec, if required by law) reserves the right to cancel, amend or suspend this Contest, or to amend these Official Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. Subject to all applicable Canadian federal, provincial, territorial and municipal laws and regulations, these Official Rules govern all aspects of the Contest and are binding on all participants. 

In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules or other statements contained in any Contest-related materials (including without limitation the French Official Rules or any advertising or promotional materials), the terms and conditions of these English Official Rules shall prevail, govern and control.

Sponsor is not claiming ownership rights to any portion of your Contest entry (“Entry”). However, by submitting an Entry, where allowed by law, you are (i) granting Sponsor a non-exclusive, irrevocable, royalty-free, worldwide right and license to use all or a portion of your Entry in connection with Microsoft products in perpetuity for the purposes of featuring all or a portion of your Entry in connection with the marketing, sale or promotion of Microsoft products (including but not limited to internal and external sales meetings, conference presentations, tradeshows, and screenshots of the contest entries on websites and in press releases) in all media (now known or later developed) without compensation or credit for use of your Contest or Entry; and (ii) waiving any moral rights in all portions of the Entry in favour of the Released Parties.

For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement. 

Subject only to the foregoing paragraph, this Contest will be governed by the laws of the province of Ontario and the country of Canada, and each entrant hereby consents to the exclusive jurisdiction and venue of the courts of the Province of Ontario for any disputes arising out of this Contest.

PRIVACY:

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry for the purpose of administering the Contest and in accordance with Sponsors privacy policy https://privacy.microsoft.com/en-gb/privacystatement. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
