COMMON TERMS USED IN THESE RULES:
These are the official rules that govern how the Xbox LIVE Activate Netflix & Win Sweepstakes promotion will operate. This promotion will be simply referred to as the "Promotion" throughout the rest of these rules.
In these rules, "we," "our," and "us" refer to Microsoft Corporation, the sponsor of the Promotion. "You," and "yourself" refers to an eligible Promotion entrant.
1. PROMOTION OVERVIEW
This Promotion consists of consecutive, separate weekly prize periods; and each weekly prize period will begin at 12:01 A.M. Pacific Time (PT) on Sunday, and end at 11:59 P.M. PT on the following Saturday (each, a "Weekly Prize Period"). For example, the first Weekly Prize Period will begin at 12:01 A.M. PT on Sunday, January 25, 2009, and end at 11:59 P.M. PT on Saturday, January 31, 2009 ("Weekly Prize Period 1").
Online entries must be received during a Weekly Prize Period. Mail-in entries must be received by the Thursday following the close of a Weekly Prize Period. Mail-in entries received after the Thursday following the close of a Weekly Prize Period will be included in the subsequent Weekly Prize Period, if any.
On the second Monday following the close of each Weekly Prize Period, we, or a company under our supervision, will conduct a drawing from among all eligible entries received. For example, we will conduct a drawing on February 9, 2009, from among all eligible entries received for Weekly Prize Period 1. Entries from one Weekly Prize Period will not carry over to any subsequent Weekly Prize Period. We may discontinue this Promotion following any Weekly Prize Period.
2. CAN I ENTER?
You are eligible to enter this Promotion if you meet the following requirements at time of entry:
You are a legal resident of the 50 United States (including the District of Columbia), and you are 18 years or older (if you are 18 years of age or older, but are considered a minor in your place of residence, you should ask your parent's or legal guardian's permission prior to submitting an entry in this Promotion ); and
- You are NOT an employee of Microsoft Corporation or an employee of a Microsoft subsidiary;and
- You are NOT involved in any part of the administration and execution of this Promotion;and
- You are NOT an immediate family (parent, sibling, spouse, child) or household member of a Microsoft employee, an employee of a Microsoft subsidiary, or a person involved in any part of the administration and execution of this Promotion.
This Promotion is void outside the geographic area described above and wherever else prohibited by law.
3. HOW DO I ENTER?
There are two ways to enter a Weekly Prize Period: online via the Xbox LIVE service, or via U.S. Mail.
To enter online via the Xbox LIVE service , you must have access to an Xbox 360® video game and entertainment system, and be an Xbox LIVE® Gold member in good standing. Once you have verified that you meet these system requirements, you must register and earn and entry as follows:
Register
To register, you must download the free Activate Netflix & Win Registration Gamer Picture ("Gamer Picture"). There are two ways to download the Gamer Picture: by accessing Marketplace on the Web using a PC or by accessing the Xbox LIVE Marketplace using an Xbox 360 console.
To download the Gamer Picture via Marketplace on the Web , do the following:
- Navigate to "Xbox LIVE Event Registrations" at http://marketplace.xbox.com/en-US/games/media/66acd000-77fe-1000-9115-d802475207f5/
- Select "Activate Netflix & Win Registration" from the list of available content and select "Download to Xbox 360"
- Select "Confirm" on the Confirm Purchase window.
- Players will see a "Congratulations! This item has been purchased and added to your download queue" message.
OR,
To download the Gamer Picture via the Xbox LIVE Marketplace , do the following:
- Sign in to Xbox LIVE and access the Game Marketplace,
- Select "Explore Game Content",
- Select "All Games",
- Select "Browse",
- Under Title, Select "X",
- Select "Xbox LIVE Event Registrations",
- Select "Activate Netflix & Win Registration" from the list of available content and select "Confirm Download".
- Upon the successful completion of the Gamer Picture download, Players will see a "Activate Netflix & Win Registration downloaded" message.
NOTE: Users may also access the free Activate Netflix & Win Registration Gamer Picture via the banner ads running on the Events Channel in the Xbox LIVE dashboard.
You must register using the same Xbox LIVE gamer profile that you used/will use to download the Netflix application and activate Netflix instant streaming on the Xbox LIVE service.
Please be sure that your Xbox LIVE gamer profile information including e-mail address, mailing address and phone is correct and current. You can update your Xbox LIVE gamer profile information as described below.
Updating Account Information:
You can verify/update your profile information via your account profile on Xbox.com or through the Xbox Dashboard:
Via the Xbox Dashboard:
- From the Xbox Dashboard, select "My Xbox" Channel.
- Select your Gamercard.
- Select "Manage Account".
- Select "Contact Information".
- Enter your account e-mail and password, and then select "Sign In".
- E-mail address is located on the Contact Information screen.
Via Xbox.com:
- Go to http://live.xbox.com/en-US/default.aspx.
- Sign in to Xbox using your Windows Live ID account email and password.
- Select "Manage Profile" on your "My Xbox" Home Page.
- Select "Billing and Contact Information".
- Update your Profile Information and then select "Save".
Earn Entries
New Instant Streaming from Netflix Users
Provided you have registered as described above, you will automatically earn one (1) entry when you log in to the Xbox LIVE service, log in to the Netflix application, and activate Netflix streaming as follows:
Activating Netflix instant streaming on your Xbox 360:
- Set-Up a Netflix Free Trial Account. (If you are already a Netflix Unlimited subscriber, please proceed to Step 2.) On your PC, go to: http://www.netflix.com/Default?mqso=80023131. Follow the instructions to create a Netflix account for the two week free trial offer. Netflix free trial offer is subject to the Netflix Terms of Use at http://www.netflix.com/TermsOfUse?lnktrk=FTI_TOU#freetrials
- Activate Netflix on your Xbox 360. Sign into your Xbox LIVE Gold account. Navigate to the Video Marketplace channel and select the Netflix slot. Select 'Confirm Download' to download the free Netflix application. Select 'Play Now' after the download. Select 'Yes, I want to activate instant watch'. Write down the activation code.
- Link your Netflix and Xbox LIVE Gold Accounts.Return to your PC, navigate to www.netflix.com/activate, sign in to your Netflix account, enter the activation code and select "Activate." Once you see the "Activation is complete" message, click on the 'Watch Instantly' tab to add movies to your Netflix Instant Queue.
- Enjoy Instant Streaming from Netflix. On your Xbox 360, you will see your Netflix Queue update. Now sit back, relax, and instantly watch movies on your TV!
Existing Instant Streaming from Netflix Users
If you are already a Netflix Ultimate subscriber, or free trial user, and you have already downloaded and activated Netflix Instant Streaming on your Xbox 360 console, as described in the "New Users" subsection above, as of January 25, 2009, then you can still earn an entry, provided you have registered as described above, by downloading the free Activate Netflix & Win Registration gamer picture ("Gamer Picture") via the Xbox LIVE Marketplace or Marketplace on the Web.
To enter by mail, without registering, downloadingthe Netflix application, and activating Instant Streaming from Netflix on your Xbox 360 console, hand-print your first and last name, mailing address, city, state, ZIP code, phone number, and e-mail address (if any) on a 3x5 piece of paper and mail it to:

Mail-in entry (ies) must be received by the Thursday after the close of the Weekly Prize Period. Mail-in entries received after the Thursday following the Weekly Prize Period will be included in the following Weekly Prize Period, if any. Limit one (1) entry per outer mailing envelope.
WE WILL ONLY ACCEPT ONE (1) ENTRY PER PERSON DURING THE ENTIRE PROMOTION, REGARDLESS OF ENTRY METHOD.
We are not responsible for entries that we do not receive for any reason, or for entries that we receive but are not decipherable for any reason.
We will automatically disqualify:
- Any incomplete or illegible entry; and
- Any entries that we receive from you that are in excess of the entry limit described above.
4. WHAT IS THE WEEKLY PRIZE?
Weekly Prize (one for each Weekly Prize Period that is a part of the Promotion). A prize package consisting of the following items:
- A Samsung Television Home Theater Package (Approximate Retail Value, (ARV), $4,190.00 USD) that consists of the following items:
- One (1) Samsung 58" 1080p Flat-panel Plasma HDTV,

We will only award one (1) prize per person during the entire Promotion.
If for any reason an advertised prize is unavailable, we reserve the right to substitute a prize of equal or greater value.
If you are selected as a potential winner of this Promotion:
- You may not exchange your prize for cash or any other merchandise or services; and
- You may not designate someone else as the winner. If you are unable or unwilling to accept your prize, we will award it to an alternate potential winner; and
- If you accept a prize, you will be solely responsible for all applicable taxes related to accepting the prize;and
- If you are otherwise eligible to enter, but you are considered a minor in your place of residence, we may award the prize to your parent/legal guardian on your behalf; and
- Unless otherwise noted, all prizes are subject to their manufacturer's warranty and / or terms and conditions.
5. HOW ARE WINNERS SELECTED AND NOTIFIED?
On or around the Saturday following the close of the Weekly Prize Period, we, or a company acting under our authorization will select (1) one potential Weekly Prize Winner in a random drawing from among all eligible entries received.
If you are a potential winner, we will notify you by sending a message to the e-mail address, the phone number, or mailing address (if any) listed on your entry within seven (7) days following the random drawing. If the notification that we send is returned as undeliverable, or you are otherwise unreachable for any reason, we may award the prize to an alternate randomly selected winner.
If there is a dispute as to who is the potential winner, we will consider the potential winner to be the authorized account holder of the e-mail address used to enter the Promotion, or the person residing at the mailing address listed on your mail-in entry.
If you are a potential winner, we may require you to sign an affidavit of eligibility, liability/publicity release and W-9 tax form. If you are a potential winner and you are 18 years or older, but are considered a minor in your place of legal residence, we may require your parent or legal guardian to sign all required forms on your behalf. If you do not complete the required forms as instructed and/or return the required forms within the time period listed on the winner notification message, we may disqualify you and select an alternate winner.
6. WHAT ARE YOUR ODDS OF WINNING?
Your odds of winning this Promotion depend on the number of eligible entries we receive during the applicable Weekly Prize Period.
7. WHAT OTHER CONDITIONS ARE YOU ARE AGREEING TO BY ENTERING THIS PROMOTION?
By entering this Promotion you agree:
- To abide by these Official Rules; and
- To release and hold harmless Microsoft and its respective parents, subsidiaries, affiliates, employees and agents from any and all liability or any injury, loss or damage of any kind arising from or in connection with this Promotion or any prize won;and
- That Microsoft's decisions will be final and binding on all matters related to this Promotion; and
- That by accepting a prize, Microsoft may use of your proper name and state of residence online and in print, or in any other media, in connection with this Promotion, without payment or compensation to you, except where prohibited by law.
8. WHAT LAWS GOVERN THE WAY THIS PROMOTION IS EXECUTED AND ADMINISTRATED?
This Promotion will be governed by the laws of the State of Washington, and you consent to the exclusive jurisdiction and venue of the courts of the State of Washington for any disputes arising out of this Promotion.
9. WHAT IF SOMETHING UNEXPECTED HAPPENS AND THE PROMOTION CAN'T RUN AS PLANNED?
If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled , (also referred to as force majeure) affects the fairness and / or integrity of this Promotion, we reserve the right to cancel, change or suspend this Promotion. This right is reserved whether the event is due to human or technical error. If a solution cannot be found to restore the integrity of the Sweepstakes, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Promotion.
If you attempt to compromise the integrity or the legitimate operation of this Promotion by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future promotions, so please play fairly.
10. HOW CAN YOU FIND OUT WHO WON?
The names of the winners will be posted online approximately two (2) weeks after the close of each Weekly Prize Period at: http://www.xbox.com/activateandwin , and will be available for at least 30 days.
