Xbox LIVE Speed Racer and PGR 4 Challenge
Official Rules
COMMON TERMS USED IN THESE RULES:
These are the official rules that govern how the Microsoft Speed Racer and PGR4 challenge promotion will operate. This promotion will be simply referred to as the "Promotion" throughout the rest of these rules.
By entering the Promotion you agree to abide by these Official Rules, the Xbox.com and Xbox LIVE Terms of Use, any other terms and conditions referenced in these Official Rules and the decisions of Sponsor, which shall be binding in all aspects. If there is any conflict between these Official Rules and the Xbox.com and/or Xbox LIVE Terms of Use, these Official Rules shall control.
In these rules, "the Sponsor," "we," "our," and "us" refer to Microsoft Corporation and Warner Brothers, the sponsors of the Promotion. "You," "yourself," "I," "me," and "my" refers to an eligible Promotion entrant.
1. TOURNAMENT DESCRIPTION
This Promotion consists of:
- A live, skill-based tournament in which eligible entrants ("Players") compete against one another on the Xbox LIVE gaming platform until an overall champion is determined as described more fully below ("Tournament"), and
- A sweepstakes in which winners are randomly selected from among all Tournament registrations received ("Sweepstakes").
2. ELIGIBILITY CRITERIA
You are eligible to participate in the Promotion if you meet the following requirements at the time of entry:
- You are a legal resident of the 50 United States including the District of Columbia 18 years of age or older; and
- You are NOT an employee of Microsoft Corporation or an employee of a Microsoft subsidiary; and
- You are NOT involved in any part of the administration and execution of this Promotion; and
- You are NOT an immediate family (parent, sibling, spouse, child) or household member of a Microsoft employee, an employee of a Microsoft subsidiary, or a person involved in any part of the administration and execution of this Promotion.
- In addition to the above eligibility requirements, in order to participate in the Tournament portion of the Promotion, you must satisfy the following system requirements:
- You are a valid Xbox LIVE Gold member in good standing with a valid Windows LIVE ID linked to your Xbox LIVE gamertag; and
- You have access to a Microsoft Xbox 360® video game and entertainment system, and the Project Gotham Racing 4 video game.
This Promotion is void outside the geographic area identified above and wherever else prohibited by law.
3. START AND END DATES
Promotion registration starts at 12:00:01 A.M. Eastern Time (ET) on April 17, 2008, and ends at 11:59:59 P.M. ET on April 25, 2008 ("Registration Period").
Tournament play starts at 4:00:01 A.M. ET on May 2, 2008, and ends at 11:59:59 P.M. ET on May 4, 2008 ("Tournament Period"), and will consist of two rounds of Tournament play.
4. HOW TO REGISTER
If you wish to participate in the Promotion, you must register online by either (1) navigating to the registration page and registering your Xbox LIVE gamertag as instructed, or (2) downloading the free Speed Racer and PGR4 Tournament gamer picture on Xbox LIVE.
To download the Gamer Picture on Xbox LIVE:
- Sign in to Xbox LIVE and access the Xbox LIVE Marketplace,
- Select "Game Store,"
- Select "Themes and Gamer Pictures,"
- Select "All Gamer Pictures,"
- Select "Speed Racer PGR4 Picture" from the list of available content and select "Confirm Download."
- Upon the successful completion of the Gamer Picture download Players will see a "Thank You for Registering" message.
You MUST play in the Tournament using the same Xbox LIVE gamertag that you use to register for the Promotion.
You are responsible for keeping your Xbox LIVE account information up to date, and all changes for e-mail addresses, phone numbers must be completed by April 16, 2008. If you fail to update your Xbox LIVE account information, you may be disqualified.
Updating Account Information (example for e-mail):
To verify/update your e-mail address:
- From the Xbox Dashboard, select "Marketplace Blade/Screen".
- Select "Account Management".
- Select "Contact Information".
- Enter your account e-mail and password, and then select "Sign In".
- E-mail address is located on the Contact Information screen. Please ensure that your contact information is up-to-date.
5. SWEEPSTAKES
You will automatically receive one (1) entry into the Sweepstakes when you register for the Promotion as instructed during the Registration Period. You can register online free and you are not required to play in the Tournament in order to be eligible for the Sweepstakes.
We will only accept one (1) registration / Sweepstakes entry per person. We are not responsible for entries that we do not receive for any reason, or for entries that we receive, but are not decipherable for any reason.
We will automatically disqualify:
- Any incomplete or illegible entry; OR
- Any entries that we receive from you that are in excess of the entry limit described above.
On or around the close of the Registration Period, we, or a company acting under our authorization, will select ten (10) potential winners in a random drawing from all eligible entries received to win a Sweepstakes Prize. Limit one (1) Sweepstakes Prize per person.
6. TOURNAMENT
The Tournament will consist of two rounds, a Qualifying Round and a Finals Round, to determine one (1) Overall Champion.
6.1 Qualifying Round
Overview
The Qualifying Round consists of two separate Daily Racing Rounds, Daily Racing Round 1 and Daily Racing Round 2. You can participate in one or both of the Daily Racing Rounds. However, only the three highest ranking unique Players from each Daily Racing Round will be invited to compete in the Finals Round. In other words, if you participate in both Daily Racing Round 1 and Daily Racing Round 2, and you are one of the three highest ranking Players in both Daily Racing Rounds, you will advance to the Finals Round from Racing Round 1 only, and the next highest ranking Player behind you in Racing Round 2 will advance to the Finals Round.
Please note: there may be ineligible players listed on a Qualifying Round leaderboard. In that event, the three highest ranking unique eligible players from each Daily Racing Round will advance to the Finals Round.
Daily Racing Round 1
Daily Racing Round 1 will begin at approximately 4:00:01 A.M. ET on May 2, 2008, or whenever the Platinum Daily Tournament Leaderboard is reset. During Daily Racing Round 1, Players will compete by playing PGR4 as more fully described below. At approximately 11:00:01 P.M. ET on May 2, 2008, Daily Racing Round 1 will end and the Platinum Daily Tournament Leaderboard will be recorded.
Daily Racing Round 2
Daily Racing Round 2 will begin at approximately 4:00:01 A.M. ET on May 3, 2008, or whenever Platinum Daily Tournament Leaderboard is reset. During Daily Racing Round 2, Players will compete by playing PGR4 as more fully described below. At approximately 11:00:01 P.M. ET on May 3, 2008, Daily Racing Round 2 will end and the Platinum Daily Tournament Leaderboard will be recorded.
How to Play during the Qualifying Round
Players will be ranked based on scores that are recorded and posted to the Platinum Daily Tournament Leaderboard. To record a score on a Platinum Daily Tournament Leaderboard during the Qualifying Round, you must do all of the following. During the Qualification Round, access Xbox LIVE from an Xbox 360 video game and entertainment, insert the PGR4 game, and do the following:
- Enter "Multi-Player" mode
- Enter "Tournament" from the Main Menu
- Navigate to the "Daily Tournament"
- Start "Daily Tournament"
- Qualify for the "Platinum Tournament"
- Compete in the "Platinum Tournament"
Game Settings for the Qualifying Round
Each Daily Racing Round that is a part of the Qualifying Round will be played on the default settings dictated by the Platinum Daily Tournament Leaderboard. Please check the Platinum Daily Tournament Leaderboard for details.
6.2 Finals Round
Overview
The three highest ranking unique Players from each Racing Round within the Qualifying Round, six total, will be invited to compete in the Finals Round of this Tournament to determine one (1) overall champion.
The Finals Round will begin at approximately 6:00:01 P.M. ET on May 4, 2008. Participation in the Finals Round will be subject to the Gameplay Details that we will establish and provide to each Finalist prior to the Finals Round. The top Player from the Finals Round will be named the Overall Champion.
7. CODE OF CONDUCT
Any Player competing in an unsportsmanlike manner or in a manner that is not in compliance with these Official Rules or the xbox.com or Xbox LIVE Terms of Use may be immediately disqualified from this Tournament and may be disqualified from competing in future xbox.com or Xbox LIVE events. Unsportsmanlike conduct includes, but is not limited to, the following violations:
Any Unsportsmanlike Conduct (voice)
- Swearing or threats
- Spamming or screaming
- Harassment
- Lewdness
- Using any device to create loud sounds
- Any other type of conduct deemed inappropriate
Unsportsmanlike Conduct (gameplay):
- Cheating of any sort through various means
- Continuous pauses during the gameplay
- Delaying or slowing gameplay using various tactics
- Intentionally disconnecting the network cable
- Intentionally interrupting network connectivity
- Using any type of modified teams
- Using memory cards or saved games
- Any other known or unknown way of tampering with gameplay
- Boosting/Patsy account use for easy wins (playing a friend over and over)
- Team standby cheating
- Using modified Xbox systems
8. WINNER NOTIFICATION
If you are a potential prize winner, we will notify you using your Xbox LIVE profile information (e-mail, address, phone). If the notification that we send is returned as undeliverable, or you are otherwise unreachable for any reason, we may award the prize to an eligible runner-up. If there is a dispute as to who is the potential winner, we will consider the potential winner to be the authorized account holder of the Xbox LIVE account used to compete in the Tournament and/or the free Xbox LIVE gamertag used to register for the Promotion, as applicable.
If you are a potential winner, we may require you to sign an Affidavit of Eligibility, Liability / Publicity Release and W-9 tax form. If you are a potential winner and you are a minor in your place of legal residence, we may require your parent or legal guardian to sign all required forms on your behalf. If you do not complete the required forms as instructed and/or return the required forms within the time period listed on the winner notification message, we may disqualify you and select an alternate winner.
9. PRIZES
One (1) Overall Champion Prize: $1,000 USD.
One (1) Runner-Up Prize: $500 USD
Ten (10) Sweepstakes Prizes: An Xbox 360 Wireless Racing Wheel (ARV: $130)
Total ARV of all prizes: $2,800 USD
If you are the winner, the following restrictions / conditions will apply to your prize.
- Odds of winning a Sweepstakes Prize depends on the number of Promotion registrants; and
- You may not exchange your prize for cash or any other merchandise or services; and
- You are responsible for all federal, state, provincial and local taxes (including income and withholding taxes) as well as any other costs and expenses associated with accepting and/or using the prize package that are not included above as being part of the prize package; and
- You understand that you are accepting the prize package "as is" with no warranty or guarantee, either express or implied by us; and
- You may not designate someone else as the winner. If you are unable or unwilling to accept your prize, the prize will be forfeited and we reserve the right to award it to the next highest ranked eligible Player; and
- If you are a minor in your place of residence, we may award the prize to your parent/legal guardian on your behalf; and
- Unless otherwise noted, all prizes are subject to their manufacturer's warranty and / or terms and conditions; and
- You understand that we shall determine all prize package details; and
- If for any reason the advertised prize is unavailable, we reserve the right to substitute a prize of equal or greater value.
10. WHAT OTHER CONDITIONS ARE YOU ARE AGREEING TO BY ENTERING THIS TOURNAMENT?
By entering this Promotion you agree:
- To abide by these Official Rules; and
- To release and hold harmless Microsoft and its respective parents, subsidiaries, affiliates, employees and agents from any and all liability or any injury, loss or damage of any kind arising from or in connection with this Promotion, or any prize won; and
- That Microsoft's decisions will be final and binding on all matters related to this Promotion; and
- That by accepting a prize, Microsoft may make use of your proper name and state of residence online and in print, or in any other media, in connection with this Promotion, without payment or compensation to you, except where prohibited by law.
This Promotion will be governed by the laws of the State of Washington, and you consent to the exclusive jurisdiction and venue of the courts of the State of Washington for any disputes arising out of this Promotion.
11. WHAT IF SOMETHING UNEXPECTED HAPPENS AND THE TOURNAMENT CAN'T RUN AS PLANNED?
If someone cheats, or a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) affects the fairness and / or integrity of this Promotion, we reserve the right to cancel, change or suspend this Promotion. This right is reserved whether the event is due to human or technical error. If a solution cannot be found to restore the integrity of the Promotion, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Promotion.
If you attempt to compromise the integrity or the legitimate operation of this Promotion by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future promotions, so please play fairly.
12. WINNERS LIST
The names of the winners will be posted at http://www.xbox.com/winners after the conclusion of the Promotion, and will remain posted until July 7, 2008.
