By entering the Major League Baseball 2K9 Xbox LIVE Play & Win Sweepstakes ("Sweepstakes") you (or, if a minor in your state of residence, your parent or legal guardian) agree to abide by these Official Rules and any other terms and conditions referenced in these Official Rules.
1. Eligibility
This Sweepstakes is only open to legal residents of the 50 United States or the District of Columbia who are 14 years of age or older at the time of entry. Employees of Microsoft Corporation ("Sponsor"), and any person engaged to work on this promotional program and their respective affiliates, parent companies, subsidiaries, advertising and promotional agencies including GMR Marketing LLC, Take-Two Interactive Software, Inc. and each of their immediate family members (including mother, father, sister, brother, child, husband or wife) and those living in their households are not eligible to enter or win.
2. Promotion Period
This Promotion begins at 12:01 A.M. Eastern Time (ET) on April 3, 2009, and ends at 11:59 P.M. ET on April 5, 2009 ("Promotion Period").
3. How To Enter
There are two ways to enter: online or via mail
To enter online , you must have access to an Xbox 360® console, and be an Xbox LIVE Gold member in good standing. Once you have verified that you meet these system requirements, you must register for the Sweepstakes and earn entries into the Sweepstakes as follows:
Register
To register, you must download the free "Major League Baseball 2K9 Registration" ("Gamer Picture"). There are two (2) ways to download the free Gamer Picture: by accessing Marketplace on the Web using a PC or by accessing the Xbox LIVE Marketplace using an Xbox 360 console.
To download the Gamer Picture via Marketplace on the Web,you must do the following:
- Navigate to http://marketplace.xbox.com/en-US/games/media/66acd000-77fe-1000-9115-d802475207f5/
- Select " Major League Baseball 2K9 Registration" from the list of available content and select "Download to Xbox 360"
- Select "Confirm" on the Confirm Purchase window.
- Players will see a "Congratulations! This item has been purchased and added to your download queue" message.
To download the Gamer Picture via the Xbox LIVE Marketplace,you must do the following:
- Sign in to Xbox LIVE and access the Game Marketplace,
- Select "Explore Game Content",
- Browse to the "Themes & Gamer Pictures" channel,
- Select "Browse",
- Under Title, Select "X",
- Select "Xbox LIVE Event Registrations",
- Select " Major League Baseball 2K9 Registration" from the list of available content and select "Confirm Download".
Upon the successful completion of the Gamer Picture download, Players will see a "Major League Baseball 2K9 Registration downloaded" message. NOTE: Users may also access the free Major League Baseball 2K9 Registration Gamer Picture via the banner ads running on the Events Channel in the Xbox LIVE dashboard.
You must register for the Sweepstakes using the same Xbox LIVE gamertag that you will use to play Major League Baseball 2K9 multiplayer (co-op) sessions on the Xbox LIVE service during the Promotion Period. Please be sure that your Xbox LIVE gamer profile information including e-mail address, mailing address and phone is correct and current. You can update your gamer profile information as described below.
Updating Account Information (example for e-mail):
You can verify/update your profile information via your account profile on Xbox.com or through the Xbox Dashboard:
From the Xbox Dashboard:
- From the Xbox Dashboard, select "My Xbox" Channel.
- Select your Gamercard.
- Select "Manage Account".
- Select "Contact Information".
- Enter your account e-mail and password, and then select "Sign In".
- E-mail address is located on the Contact Information screen.
Via Xbox.com:
- Go to http://live.xbox.com/en-US/default.aspx.
- Sign in to Xbox using your Windows Live ID account email and password.
- Select "Manage Profile" on your "My Xbox" Home Page.
- Select "Billing and Contact Information".
- Update your Profile Information and then select "Save".
Earn an Entry
Provided you have registered for this Sweepstakes as described above, you will automatically receive one (1) entry when you log into the Xbox LIVE service and play a Major League Baseball 2K9 multiplayer session. Limit one (1) entry per person.
To enter by mail, without registering or playing Major League Baseball 2K9 game on the Xbox LIVE service, hand-print your name, address, city, state, ZIP code, phone number, e-mail address (if any) on a 3x5 piece of paper and mail it to:

Mail-in entry (ies) must be postmarked by Monday, April 6, 2009, and received by Monday, April 13, 2009, to be eligible. Limit one (1) entry per outer mailing envelope.
ENTRY LIMIT: LIMIT ONE (1) ENTRY PER PERSON, REGARDLESS OF ENTRY METHOD. Entries from the same individual or e-mail or household address received in excess of the limits stated herein will be automatically disqualified.
The use of automated devices to enter this Sweepstakes is prohibited. Microsoft assumes no responsibility for lost, late, misdirected, mutilated, postage due or illegible entries or any computer, online telephone, or technical malfunctions that may occur. All entries become Microsoft's property and will not be returned.
4. Winner Selection / Prizes
On or around April 27, 2009, we will select three (3) potential First Prize Winners, five (5) potential Second Prize Winners, seven (7) potential Third Prize Winners, ten (10) potential Fourth Prize Winners, and three (3) potential Grand Prize Winners from among all eligible entries received.
Ten (10) Fourth Prizes. A prize package consisting of the following items:

Three (3) Grand Prizes available. A prize package consisting of the following items:
- A baseball autographed by a Major League Baseball player
- Two tickets to a regular Season Major League Baseball game of winner's choice (subject to availability, restrictions apply). This portion of the prize consists of tickets to the designated event only, and does not include travel or accommodations, which will be the sole responsibility of the winner.
- $100 Cash

All random drawings will be conducted under the supervision of Sponsor, whose decisions are final. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period. Limit one (1) prize per person.
Prizes are not redeemable for cash. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event an offered prize is unavailable. Taxes on the prizes are solely the responsibility of the winner. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer's terms and conditions, and winners agree to look solely to such manufacturers for any such warranty or guarantee claim.
5. General Conditions
Sweepstakes entrants agree to abide by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Sweepstakes. This Sweepstakes is governed by the laws of the United States. All federal, provincial, state and local laws and regulations apply. Winners will be notified within seven (7) days after the drawing date via email and may be required to execute an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days following the date of attempted notification. Failure to return an Affidavit of Eligibility and Liability / Publicity Release within the specified time period may result in disqualification and either selection of an alternate winners or forfeiture of prize. Return of any prize / prize notification as undeliverable or failure to accept any prize within the specified time period may result in disqualification and either selection of an alternate winner or forfeiture of prize. Entrants further grant to Sponsor the right to use and publish their proper name and state online and in print in any other media in connection with the Sweepstakes. Acceptance of a prize constitutes permission for Sponsor to use winner's names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants release and hold harmless Sponsor, GMR Marketing LLC, Take-Two Interactive Software, Inc. and their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes or any prize won.
6. Internet
If for any reason the Internet portion of this Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend this Sweepstakes. In any such event, Microsoft, at its sole discretion, will select the winner(s) from eligible, non-suspect entries received prior to the event requiring such termination, suspension or cancellation. Microsoft assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Microsoft is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Microsoft on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries made by Internet will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
7. Winners List
The names of the winners will be posted online on or around Monday, May 11, 2009, at: http://www.xbox.com/winners, and this list will remain posted for at least thirty (30) days.
