The Microsoft Xbox LIVE GTA IV Sweepstakes
Official Rules
1) PROGRAM DESCRIPTION: NO PURCHASE NECESSARY TO ENTER OR WIN. Sweepstakes begins at 12:01 A.M. Pacific Time (PT) on March 1, 2008 and ends at 11:59 P.M. PT on April 14, 2008 (“Promotion Period”). The winners will be selected in a random drawing from among all eligible entries received.
2) HOW TO ENTER: Access the official sweepstakes entry form online and complete and submit as instructed. You must have a valid Xbox gamertag linked to a Windows Live ID account to enter. To obtain a free Xbox LIVE gamertag and free Windows Live account, visit http://www.xbox.com/en-US/myxbox/myprofile.htm and follow the instructions provided. Before registering for the sweepstakes, make sure your Xbox LIVE account information is accurate. Potential winners will be notified by the administrator and have their prizes shipped using the Contact Info (e-mail, phone, and address) on their Xbox LIVE profile. If your contact info is not up-to-date, you will be disqualified from winning a prize. Limit: one (1) entry per person and Xbox gamertag. Multiple entries submitted by a single entrant in excess of the entry limit are void. Entrants must complete all required information requested on the online entry form to be eligible. Sponsor assumes no responsibility for lost, late, or misdirected entries or for any computer, online, telephone, or human error or technical malfunctions that may occur. All entries become the property of the Sponsor and will not be returned. Information submitted by entrants will only be used to contact them with information related to the sweepstakes, unless otherwise authorized by the entrant.
3) WINNER SELECTION: The winner will be selected in a random drawing from among all eligible entries received. The drawing will be conducted on or about April 23, 2008, under the supervision of an independent judging organization, whose decisions are final on matters relating to this sweepstakes. Odds of winning depend on the number of eligible entries received.
4) PRIZES: Four (4) Grand Prizes. A four (4) day / three (3) night trip for the winner and a guest to New York, NY, to attend the Xbox LIVE Gold Party in New York. Trip includes round trip coach air transportation for winner and a guest from a major U.S. commercial airport nearest winner's home, three (3) nights standard, double occupancy hotel accommodations (one room, two people), ground transportation in New York to and from the airport and the hotel and $200 cash, awarded as a check from the Sweepstakes Administrator. Approximate Retail Value (ARV) of Grand Prize: $2,500.
One Hundred (100) First Prizes. A custom Xbox 360 Elite console. ARV of First Prize: $500.00. Two Thousand (2,000) Second Prizes: A Rockstar baseball bat. ARV of Second Prize: $50.00. Five Thousand (5,000) Third Prizes: 500 Microsoft Points. ARV of Third Prize: $6.25. Three Thousand (3,000) Fourth Prizes. 1,000 Microsoft Points. ARV of Fourth Prize: $12.50. Two Thousand (2,000) Fifth Prizes. 1,600 Microsoft Points. ARV of Fifth Prize: $20.00. Five Thousand (5,000) Sixth Prizes. A one (1) month Xbox LIVE Gold subscription. ARV of Sixth Prize: $7.99. Three Thousand (3,000) Seventh Prizes: A three (3) month Xbox LIVE Gold subscription. ARV of Seventh Prize: $19.99. Two Thousand (2,000) Eighth Prizes. A one (1) year Xbox LIVE Gold subscription. ARV of Eighth Prize: $49.99. Total ARV of all prizes: $468,650.
Any applicable taxes on a prize or expenses not listed herein are the sole responsibility of the winner. Sponsor reserves the right to substitute a prize of equal or greater value if entire prize or a portion of an advertised prize is unavailable for any reason. No barter, transfer, or assignment of any prize permitted, except by Sponsor at its sole discretion. Prizes are not redeemable for cash. Limit: One (1) prize per person. Travel companions will be required to execute a Liability/Publicity Release prior to issuance of travel documents. If a travel companion is a minor, he/she must be accompanied by a parent or legal guardian at his/her own expense if the parent/guardian is not a Winner. Travel subject to availability and must be completed on dates specified by the Sponsor or prize will be forfeited and awarded to an alternate winner.
Grand Prize winners are solely responsible for obtaining any and all travel documentation necessary for travel. Some restrictions may apply. No cancellation of reservation or transfer of reservation to another date after reservation has been made. If a winner lives within 100 miles of the event location, we reserve the right to substitute an alternate means of transportation for air travel. If a prize is won by a minor, it will be awarded to Parent/Legal Guardian of minor on his/her behalf. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer’s terms and conditions, and winners agree to look solely to such manufacturers for any such warranty or guarantee claim. Usage of Microsoft Points and Xbox LIVE subscription cards is subject to the Terms and Conditions of Microsoft Corporation governing such use.
5) ELIGIBILITY: This sweepstakes is open only to legal residents of the 50 United States and District of Columbia 18 years of age or older at the time of entry. Void where prohibited by law. Employees, directors and officers and their immediate families (parents, children, siblings, spouses) and household members of Microsoft Corporation, its divisions, affiliates, subsidiaries, franchisees, retailer, retailer personnel, agents, and/or their advertising, promotional and/or fulfillment agencies (including Marden-Kane, Inc) (collectively, the “Related Entities”) are not eligible to enter.
6) GENERAL CONDITIONS: Sweepstakes entrants agree to be bound by the terms of these official rules. The laws of the United States govern this Sweepstakes. All federal, state, and local laws and regulations apply. The winners will be notified via U.S. Mail and/or e-mail within two (2) weeks of prize drawing. The winners (or parent/legal guardian if winner is not age of majority in State of legal residence) may be required to execute and return an Affidavit of Eligibility and Liability and where legal, Publicity Release within fourteen (14) days following the date of issuance of notification. Non-compliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. Acceptance of prize constitutes permission for Microsoft Corporation to use winner’s name and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. This includes, but is not limited to, disclosing the winner’s first initial, last name, and hometown in any requested winners list. By entering, participants release and hold harmless Microsoft Corporation and its respective parents, subsidiaries, affiliates, directors, officers, prize suppliers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes or acceptance or use of any prize won.
7) INTERNET: The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this sweepstakes or downloading any materials in this Sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
8) WHO WON: To receive name of the winner by U.S. mail after May 15, 2008, please mail a self addressed stamped envelope to: Xbox GTA IV Winners, P.O. Box 710, Sayreville, NJ 08871-0710.
