Trifecta Prize Draw Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN THIS PRIZE DRAW.

These are the official rules that govern how the Microsoft "Trifecta" Prize Draw promotion will operate. This promotion will be referred to as the "Prize Draw" throughout the rest of these rules. In these rules, "we," "our," and "us" refer to Microsoft Corporation, the sponsor of the Prize Draw. "You" refers to an eligible Prize Draw entrant.

1. WHAT ARE THE START AND END DATES?
This Prize Draw entry period starts at 12:01 A.M. Pacific Time (PT) on April 7, 2009, and ends at 11:59 P.M. PT on April 20, 2009 ("Entry Period"). Non-US participants should visit http://www.worldtimeserver.com, or similar time zone calculator, to determine local time. Entries must be received within the Entry Period to be eligible.

2. CAN YOU ENTER?
You are eligible to enter this Prize Draw if you are at least 18 years of age and meet the following requirements at time of entry:

• You are a legal resident of one of the following countries: Canada (excluding Quebec), France, Germany, United Kingdom, or 50 United States or District of Columbia.
• You are NOT an employee of Microsoft Corporation or an employee of any Microsoft subsidiary; and
• You are NOT involved in any part of the administration or execution of this Prize Draw; and
• You are NOT an immediate family member (defined as parent, sibling, spouse, child regardless of where they live) and do not reside in the same household as a Microsoft employee, an employee of a Microsoft subsidiary, or a person involved in any part of the administration or execution of this Prize Draw.

If you are 18 years of age or older, but are considered a minor in your place of residence, you should ask your parent's or legal guardian's permission prior to submitting an entry in this Prize Draw.

This Prize Draw is void in the Province of Quebec, outside the countries/regions identified above, and wherever prohibited by law.

For residents of France only: These Official Rules have been filed with Maître AGNUS, Huissier de Justice, 11 Quai Anatole France, 75007 Paris. If you are a resident of France, you can obtain a copy of the rules by sending a request with your first and last name, address, city/town, province or state, postal code, country, and phone number (including applicable country/city prefixes) via email to XboxLIVEpromo@gage.com with the subject heading "The Microsoft Trifecta Prize Draw Rules Request".

3. HOW DO YOU ENTER?
There are two ways to enter this Prize Draw: online via the Xbox LIVE service or via the free alternate method of entry designated for your country of residence as follows:

To enter online, you must have access to an Xbox 360 video game and entertainment system, and be an Xbox LIVE Silver or Gold member in good standing. Once you have verified that you meet these system requirements, you must register for the Prize Draw and earn entries as described in this section:

Register for the Prize Draw
You must register for the Prize Draw before the close of the Entry Period. To register, sign in to the Xbox LIVE Marketplace and download the free "Trifecta" Registration Gamer picture ("Gamer Picture").

For Canada, UK, France and Germany residents: To download the free Gamer Picture, you must do the following:

1. Sign in to Xbox LIVE and access, "Game Marketplace",
2. Select "Themes & Gamer Pictures",
3. Select "Browse",
4. Select "All",
5. Select "X",
6. Select "Xbox LIVE Event Registrations",
7. Select "All Downloads",
8. Select the free "Trifecta Gamer Picture" from the list of available content and select "Confirm Download".
9. Upon the successful completion of the Gamer Picture download, you will see a "Trifecta Gamer Picture downloaded" message.

For U.S. residents only: To download the free Gamer Picture, you must do the following:

1. Log on to Xbox LIVE Event Registrations
2. Select the free "Trifecta Gamer Picture" from the list of available content and select "Download to Xbox 360",
3. Select "Confirm",
4. Upon the successful completion of the Gamer Picture download, you will see a "Congratulations! This item has been purchased and added to your download queue" message.

NOTE: Users may also access the free Trifecta Registration Gamer Picture via the banner ads running on the Xbox LIVE dashboard.

You MUST register for the Prize Draw using the same Xbox LIVE gamertag that you will use when you download eligible content via the new Xbox LIVE Experience during the Entry Period. You may obtain a free Xbox LIVE gamertag through Xbox LIVE.

Please be sure that your Xbox LIVE gamer profile information including e-mail address, mailing address and phone is correct and current. Winners will be notified by sending a message to the contact information tied to their Xbox LIVE account membership (if applicable). You can update your account information as described below.

Updating Account Information (example for e-mail):
To verify/update your e-mail address:

1. Navigate to My Xbox and sign in to Xbox LIVE,
2. Select your Profile,
3. Choose "Manage Account",
4. Select "Contact Information",
5. Enter your account e-mail and password, and then select "Sign-In",
6. Update your contact information as needed.

Earn Entries
Provided that you have registered for this Prize Draw as described above, you will automatically receive one (1) entry into the Prize Draw when you log into the New Xbox Experience and redeem Microsoft Points for any three (3) premium video items in the categories listed below (PLEASE NOTE: options vary by country):

To enter without registering online or downloading eligible content:

For residents of Canada (excluding Quebec): On a 3"x5" piece of paper, hand-print your first and last name, address, city, state/province, ZIP/postal code, country, email address, and phone number (including applicable country/city prefixes), and mail it to:

If you enter by email, you will receive one (1) entry into the Prize Draw when you send three (3) email messages submitted to the above address, to be received beginning 12:01 a.m. PT on April 7, 2009 and 11:59 p.m. PT on April 20, 2009.

For residents of 50 United States or District of Columbia: On a 3"x5" piece of paper, hand-print your first and last name, address, city, state/province, ZIP/postal code, country, email address, and phone number, and mail it to:

If you enter by mail, there is a limit of one (1) entry per outer envelope, and each entry must be postmarked on or between April 7, 2009, and April 20, 2009, and received by April 28, 2009.

There is a maximum limit of THREE (3) total entries per person, regardless of entry method.

We are not responsible for entries that we do not receive for any reason, or for entries that we receive, but are not decipherable for any reason.

We will automatically disqualify:
1. Any incomplete or illegible entry; OR
2. Any entries that we receive from you that are in excess of the entry limit described above.

For residents of France only: Telecommunication and access expenses corresponding to the time of connection on the Prize Draw have been evaluated at the flat fee of 0.50 euros per entry and shall be reimbursed to any online participant requesting it in writing by sending an email with your first and last name, address, city/town, providence or state, postal code, country, and phone number (including applicable country/city prefixes) to XboxLIVEpromo@gage.com with the subject heading "The Microsoft Trifecta Prize Draw Expense Request". The participants claiming reimbursement of the costs of connection must provide their telephone bill justifying that they do not benefit from unlimited access.

4. WHAT ARE THE PRIZES?

Fifteen (15) Grand Prizes: 20,000 Microsoft Points (ARV, $250 USD per Grand Prize)

The total Approximate Retail Value of all prizes is: $3,750 USD. Limit one (1) prize per person.

Microsoft Points will be issued in the form of Microsoft Point Cards. In the event that Microsoft Points are unavailable for any reason, Sponsor reserves the right to award a substitute prize of equal or greater value.
If you are selected as a potential winner:

1. You may not exchange your prize for cash or any other merchandise or services;
2. You may not designate someone else as the winner. If you are unable or unwilling to accept your prize, we will award it to an alternate potential winner;
3. If you accept a prize, you will be responsible for all applicable taxes related to accepting the prize, if any; and
4. If you are a minor (being under the age of majority) in your place of residence we may award the prize to your parent/legal guardian on your behalf.

Unless otherwise noted, all prizes are subject to their manufacturer's warranty and / or terms and conditions.

5. HOW ARE WINNERS SELECTED AND NOTIFIED?
At approximately 3:00 P.M. CT on May 7, 2009, at 10000 Highway Fifty Five, Minneapolis, Minnesota 55414 USA, we, or a company acting under our authorization, will select fifteen (15) potential winners in a random drawing from all eligible entries received.

If you are a potential winner, we will notify you by mail using the contact information provided on your winning entry. If the prize/prize notification that we send is returned as undeliverable, or you are otherwise unreachable for any reason, we may award the prize to an alternate randomly selected winner.

If there is a dispute as to who is the potential winner, we will consider the potential winner to be the authorized account holder of the e-mail address used to enter the Prize Draw. If you are a potential winner, we may require you to sign a Declaration of Eligibility and Liability/Publicity Release. If you are a potential winner and if you are a minor in your state/province/country of residence, we may require your parent or legal guardian to sign all required forms on your behalf. If you do not complete the required forms as instructed and/or return the required forms within the time period listed on the winner notification message, we may disqualify you and select an alternate winner.

For residents of Canada (excluding Quebec): If you are a potential winner, you will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by either telephone or email. If you answer the skill-testing question incorrectly, as determined by us in our sole discretion, you will be disqualified and, at our discretion, an alternate winner shall be chosen from among all remaining eligible entries.

6. WHAT ARE YOUR ODDS OF WINNING?
Your odds of winning depend on the number of eligible entries we receive.

7. WHAT OTHER CONDITIONS ARE YOU ARE AGREEING TO BY ENTERING THIS PRIZE DRAW?
By entering this Prize Draw you agree:

1. To abide by these Official Rules;
2. To the extent allowable under applicable law, to release and hold harmless Microsoft and its respective parents, subsidiaries, affiliates, employees and agents from any and all liability or any injury, loss, damage, right, claim or action of any kind arising from or in connection with this Prize Draw or any prize won, save for residents of the United Kingdom, France and Germany with respect to claims resulting from death or personal injury arising from Microsoft's negligence and for residents of the United Kingdom with respect to claims resulting from the tort of deceit or any other liabilities that may not be excluded by law;
3. That Microsoft's decisions will be final and binding on all matters related to this Prize Draw; and
4. That by accepting a prize, Microsoft may use your name and place of residence online and in print, or in any other media, in connection with this Prize Draw, without payment or compensation to you. The declaration of eligibility, use, indemnity and liability/publicity release provided to the potential winner (pursuant to clause 5 above) will make reference to obtaining your free consent to use your name and place of residence. In any case, the lack of such consent does not prevent the winner from receiving the prize.

8. WHAT LAWS GOVERN THE WAY THIS PRIZE DRAW IS EXECUTED AND ADMINISTRATED?
This Prize Draw will be governed by the laws of the United States and the State of Washington, and you consent to the exclusive jurisdiction and venue of the courts of the State of Washington, United States for any disputes arising out of this Prize Draw.

For residents of the United Kingdom only: The provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.

9. WHAT IF SOMETHING UNEXPECTED HAPPENS AND THE PRIZE DRAW CAN'T RUN AS PLANNED?
If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) affects the fairness and / or integrity of this Prize Draw, we reserve the right to cancel, change or suspend this Prize Draw unless to do so would be prohibited by law and subject to any written directions from a regulatory authority. This right is reserved whether the event is due to human or technical error or Act of God. If a solution cannot be found to restore the integrity of the Prize Draw, subject to any directions from a regulatory authority, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Prize Draw.

If you attempt to compromise the integrity or the legitimate operation of this Prize Draw by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future Promotions, so please play fairly.

10. HOW CAN YOU FIND OUT WHO WON?
We will post the names of confirmed winners online after June 1, 2009 at www.xbox.com/winners. This list will remain posted for at least thirty (30) days.
