By entering the GAMER Download & Win Sweepstakes ("Sweepstakes") you agree to abide by these Official Rules and any other terms and conditions referenced in these Official Rules.
ELIGIBILITY
This Sweepstakes is only open to legal residents of the 50 United States (includes the District of Columbia) who are 18 years of age or older at the time of entry. Officers, directors and employees of Microsoft Corporation ("Sponsor") or Lions Gate Entertainment Corp. ("Lions Gate"), any person engaged to work on this promotional program, advertising and promotional agencies including GMR Marketing LLC, and all others associated with the manufacture, distribution, development and execution of this Sweepstakes and its prizes and each of their respective affiliates, parent companies, subsidiaries, directors, officers, employees, and agents (collectively, "Released Parties"), and each of their immediate family members (including mother, father, sister, brother, child, husband or wife) and those living in their households are not eligible to enter or win. Lions Gate is not responsible for the collection, submission or processing of entries, the administration of the Sweepstakes or the selection of winners.
1. ENTRY PERIOD
This Sweepstakes begins at 12:00 A.M. Pacific Time (PT) on August 10, 2009, and ends at 11:59 P.M. PT on September 6, 2009 ("Entry Period").
2. HOW TO ENTER
Enter online by downloading the free gamer picture pack.
There are two (2) ways to download gamer picture pack: via the Xbox LIVE Marketplace, or via Xbox LIVE Marketplace on the Web:
To download the gamer picture pack via the Xbox LIVE Marketplace, you must have access to an Xbox 360® console and be an Xbox LIVE Gold or Silver member in good standing. Once you have verified that you meet these system requirements, you will automatically receive one (1) entry when you sign in to the Xbox LIVE service via an Xbox 360 console and download the free GAMER gamer picture pack during the Entry Period as follows:
- Sign in to Xbox LIVE and access the Game Marketplace,
- Select "Themes & Gamer Pictures,"
- Select "Browse,"
- Under Title, Select "G"
- Select "GAMER Picture Pack" from the list of available content and select "Confirm Download."
- Upon the successful completion of the Gamer Picture download, Players will see a "GAMER Picture Pack downloaded" message.
NOTE: Users may also access the free Gamer Pictures via the banner ads running on the Xbox LIVE dashboard.
To download the Gamer Picture via the Xbox LIVE Marketplace on the Web, you must be an Xbox Gold or Xbox LIVE Silver member. You can obtain an Xbox LIVE Silver membership for free at: http://live.xbox.com/en-US/default.aspx. Once you have verified that you meet these system requirements, you will automatically receive one (1) entry when you navigate to Xbox LIVE Marketplace on the Web and download the free Gamer Picture during the Entry Period as follows:
- Navigate to http://www.xbox.com/GAMERPROMO
- Select " GAMER gamer picture pack" from the list of available content and select "Download to Xbox 360."
- Select "Confirm" on the Confirm Purchase window.
- Players will see a "Congratulations! This item has been purchased and added to your download queue" message.
We will contact the Prize Winners using the phone number tied to the Xbox LIVE gamertag used to earn an entry. Please be sure that your Xbox LIVE gamertag profile information including e-mail address, mailing address and phone number is correct and current. You can update your Xbox LIVE gamertag profile information as described below.
Updating Account Information (example for e-mail):
You can verify/update your profile information via your account profile on Xbox.com or through the Xbox Dashboard:
From the Xbox Dashboard:
- From the Xbox Dashboard, select "My Xbox" Channel.
- Select your Gamercard.
- Select "Manage Account".
- Select "Contact Information".
- Enter your account e-mail and password, and then select "Sign In".
- E-mail address is located on the Contact Information screen.
Via Xbox.com:
- Go to http://live.xbox.com/en-US/default.aspx.
- Sign in to Xbox using your Windows Live ID account email and password.
- Select "Manage Profile" on your "My Xbox" Home Page.
- Select "Billing and Contact Information".
- Update your Profile Information and then select "Save"
To enter by mail without registering online or downloading content, hand-print your first and last name, address, city, state, ZIP code/postal code, phone number and e-mail address (if any) on a 3x5 piece of paper and mail it to:

Mail-in entry (ies) must be postmarked by September 8, 2009 and received by September 15, 2009 to be eligible.
ENTRY LIMIT: LIMIT ONE (1) ENTRY PER PERSON, REGARDLESS OF ENTRY METHOD. Entries from the same individual or e-mail or household address received in excess of the limits stated herein will be automatically disqualified.
The use of automated devices to enter this Sweepstakes is prohibited. Microsoft assumes no responsibility for lost, late, misdirected, mutilated, postage due or illegible entries or any computer, online telephone, or technical malfunctions that may occur. All entries become Microsoft's property and will not be returned.
3. WINNER SELECTION / PRIZES
On or around September 30, 2009, Sponsor or its Administrator will select one (1) Grand Prize winner, one (1) First Runner-Up winner, one (1) Second Runner-Up winner, and one (1) Third Runner-Up winner from among all eligible entries received.
The Grand Prize winner will receive:
- 80,000 Microsoft Points, Approximate Retail Value, ARV, $1K
First Runner-Up winner will receive:
- 60,000 Microsoft Points, ARV, $750
Second Runner-Up winner will receive:
- 40,000 Microsoft Points, ARV, $500
Third Runner-Up winner will receive:
- 20,000 Microsoft Points, ARV, $250
Total ARV of all prizes: $2500
Microsoft Points are non-transferrable and are subject to the terms and conditions of the Microsoft Points program. All random drawings will be conducted under the supervision of Sponsor, whose decisions are final. Limit one (1) prize per person. Odds of winning are based on the number of eligible entries received. Prizes are not redeemable for cash. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event an offered prize is unavailable. Taxes on the prizes are solely the responsibility of the winners. Any and all guarantees, warranties and restrictions with respect to the prizes are subject to the manufacturer's terms and conditions, and winners agree to look solely to such manufacturers for any such warranty or guarantee claim.
4. GENERAL CONDITIONS
Sweepstakes entrants agree to abide by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Sweepstakes. This Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply.
Winner will be notified on or around October 5, 2009, via the phone number or email address tied to the Xbox LIVE gamertag used to enter this Sweepstakes, and may be required to execute an Affidavit of Eligibility, Liability/Publicity Release within three (3) days following the date of attempted notification. Failure to return an Affidavit of Eligibility and Liability / Publicity Release within the specified time period may result in disqualification and either selection of an alternate winners or forfeiture of prize.
Return of any prize / prize notification as undeliverable or failure to accept any prize within the specified time period may result in disqualification and either selection of an alternate winner or forfeiture of prize. Entrants further grant to the Released Parties the right to use and publish their proper name and state online and in print in any other media in connection with the Sweepstakes. Acceptance of a prize constitutes permission for Released Parties to use winner's names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants agree that the Released Parties (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, personal injury or death to any winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, receipt, possession, use or misuse of a prize (including any travel or activity-related thereto or any injury or harm that may result from the use of a vehicle) or participation in this Sweepstakes and any activity or travel related thereto; and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize's quality or fitness for a particular purpose.
5. INTERNET
If for any reason the Internet portion of this Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend this Sweepstakes. In any such event, Microsoft, at its sole discretion, will select the winner(s) from eligible, non-suspect entries received prior to the event requiring such termination, suspension or cancellation. Microsoft assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Microsoft is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Microsoft on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries made by Internet will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

The names of the winners will be posted online at: http://www.xbox.com/winners, and will remain posted for at least 30 days.
