NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW. By entering The Family Game Night Bomberman Sweepstakes ("Sweepstakes"), presented by Microsoft, you agree to abide by these Official Rules and any other terms and conditions referenced in these Official Rules.
1. ELIGIBILITY Open only to legal residents of the 50 United States and District of Columbia who are 13 years or older at the time of entry. Employees of Microsoft Corporation and any person engaged to work on this promotional program and their respective affiliates, parent companies, subsidiaries, advertising and promotional agencies and each of their immediate family members (including mother, father, sister, brother, child, husband or wife) and those living in their households are not eligible to enter or win.
2. ENTRY PERIOD This Sweepstakes opens at 12:01 AM Pacific Time (PT) on August 21, 2007, and ends at 11:59 PM PT on August 26, 2007("Entry Period").
3. HOW TO ENTER: Entry Limit: Limit one (1) entry per person and email address. Subsequent entries from the same individual or e-mail address will be automatically disqualified. The use of automated devices to enter Sweepstakes is prohibited. No responsibility is assumed by Microsoft for lost, late, misdirected, mutilated, or illegible entries or any computer, online telephone, or technical malfunctions that may occur. All entries become the property of Microsoft and will not be returned.
4. WINNER SELECTION/PRIZES: On or around August 28, 2007, nineteen (19) winners will be selected in random drawing from among all eligible entries received to win a Bomberman T-shirt. (Estimated Retail Value (ERV), $10.00). Any expenses not explicitly listed herein, including any applicable tax on the prize, are the sole responsibility of the winner. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event an offered prize is unavailable. Prize is not redeemable for cash. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer's terms and conditions, and winner agrees to look solely to such manufacturers for any such warranty or guarantee claim. The random drawing will be conducted under the supervision of Sponsor, whose decisions are final. Odds of winning depend on the number of eligible entries received.
5. GENERAL CONDITIONS Sweepstakes entrants agree to abide by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Sweepstakes. This Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply. Winners will be notified within seven (7) days after the drawing date via the e-mail address provided at the time of entry, and may be required to execute an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days following the date of attempted notification. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Return of any prize / prize notification as undeliverable or failure to accept prize within the specified time period may result in disqualification and selection of an alternate winner. If you are selected as potential winner and are considered to be a minor in your state of legal resident, but you are otherwise eligible to enter, we may require that your parent or legal guardian be designated as the winner and execute the Affidavit of Eligibility and Liability/Publicity Release. Further, by entering, you grant to Sponsor the right to use and publish your proper name and state online and in print in any other media in connection with the Sweepstakes. Acceptance of a prize constitutes permission for Sponsor to use winner's names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants release and hold harmless Sponsor, its respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes or any prize won.
6. INTERNET If for any reason the Internet portion of this Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend this Sweepstakes. In any such event, Microsoft, at its sole discretion, will select the winner(s) from eligible, non-suspect entries received prior to the event requiring such termination, suspension or cancellation. Microsoft assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Microsoft is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Microsoft on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. Entries made by Internet will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. 7.
