Xbox Live Usage Rules

  • Unless otherwise stated, capitalized terms shall have the same meanings as the same terms used in the Terms of Use (“Terms of Use”) for the Services.
  • Authorized uses typically require the prior written consent of the copyright owner:
    • All apps, games and associated content provided under the Services are licensed and not sold. Your license is conditioned upon your compliance with the Terms of Use, the Xbox Live Usage Rules, and any Additional Terms. Except as permitted below, you may not transfer or resell any app, game, or associated content, or any licenses to any content provided through the Services. If you sell any device containing apps, games or associated content obtained via the Services, the purchaser of the device does not acquire any licenses or rights to use any apps, games or associated content stored on the device.
    • Any reproduction, redistribution, transmission, display, sale, broadcast, public performance, rental or lending, modification, adaptation, sub-license or other use of the content (including apps, games and associated content) provided through the Services, except as otherwise expressly permitted in the Terms of Use, this usage rules site, or by copyright law, is expressly prohibited without the prior written consent of the copyright owner.

Xbox One Digital Games

  • How many consoles can I use a game on?

You will get a device license and a user license to every game you download from the Services. You can designate one console as your “Home” console and multiple users can select the same console for their Home console. The device license will automatically attach to your Home console, even if it’s not the console you are making the purchase from. As the purchaser of the game, the user license will be associated with your Xbox Live account.

  • Who can use my game?

Anyone can use your game on your Home console under your device license. When you log onto any other console with your Xbox Live account, you may use all games to which you have a user license.

  • Can I change my Home console to a different console?

You can change which console is your Home console up to 3 times during a one year period (365 days). When you change Home consoles, all device licenses for digital content will move to your new Home console and will no longer be available on your old “Home” console.

Xbox 360 Digital Games

  • How many consoles can I use a game on and who can use it?
    You can use games on the first Xbox 360 console you downloaded it to. Access to the game will also be granted to all users on the first console. If you transfer the game using a memory unit or other storage device, you will also be able to use it on other Xbox 360 consoles, but you’ll need to sign in to Xbox Live with your Xbox Live account on that console before accessing the game.

Xbox Music Pass

  • What is an Xbox Music Pass subscription?
    • An Xbox Music Pass subscription allows you to stream or download from the Services in your territory as many songs as you want on a subscription basis for a flat monthly fee.
  • What might cause you to lose access to music previously downloaded, streaming music, and/or store credit?
    • Failure to pay monthly fee
    • Change of territory
    • Failure to sign into Services at least once every 30 days might allow digital licenses to expire and therefore deprive you of access to previously downloaded content
      • For music downloaded onto external devices, you may need to connect these devices to a computer and log into the Services to maintain access to content
    • Violation of the Xbox Live Terms of Use
  • What are the limits to use of the Xbox Music Pass subscription?
    • Personal and non-commercial use only. We may terminate or suspend your subscription to the Xbox Music Pass subscription if we determine you are using the Services in a manner that is not consistent with normal, personal use.
    • You may only stream content to one Authorized Device at a time. See xbox.com/music for the current list of compatible devices.
    • Your device’s capability to burn or export content does not modify rights of copyright owners of video, audio, image content.
    • You cannot burn Xbox Music Pass subscription content and/or playlists containing subscription content to a CD.
    • You cannot use music obtained through an Xbox Music Pass subscription as a ringtone on a mobile phone without the prior written consent of the copyright owner.
    • Number of Authorized Devices:
      • If you are an Xbox Music Pass user of the $14.99/month offer in the United States that includes 10 MP3 credits each month, you may download music on up to three (3) personal computers and up to three other (3) Authorized Devices.
      • If you subscribe to any other Xbox Music Pass paid offer, you may download music on up to four (4) Authorized Devices, including personal computers and portable devices, so long as one is a personal computer.
      • All other Xbox Music Pass users may only stream content to one Authorized Device at a time.
  • Usage Rules for music purchased separately from the Xbox Music Pass premium monthly subscription
    • Content purchased or acquired on a personal computer as part of a promotional bundle cannot be re-downloaded onto Xbox consoles
    • For DRM-protected sound recordings:
      • Music can be kept after the subscription is terminated.
      • Music may be burned onto CDs for personal and non-commercial use.
        • Songs may be burned an unlimited number of times
        • Identical playlists can be burned a maximum of seven (7) times.
      • Music can be authorized on up to five (5) personal computers and a reasonable number of Authorized Devices for personal and non-commercial sues.
        • Computers may be de-authorized to allow other personal computers to become authorized.
    • For DRM-free sound recordings:
      • Music can be kept after the subscription is terminated.
      • You are authorized to make copies of recordings as are reasonably necessary for your personal and non-commercial use. Any other copying of music may constitute copyright infringement.
      • Music may be burned onto CDs for personal and non-commercial use.
  • Usage Rules for Television and Film Videos
    • If the terms on this site conflict with other Terms of Use, these terms control.
    • Video content may only be streamed when streaming is authorized under the Service.
    • Resolution of content purchased in high definition may vary based on content, hardware used, and bandwidth of your Internet connection.
    • We may terminate or suspend your use of the Services if we determine you are using the Service in a manner that is not consistent with normal, personal use.
    • For purposes of the Usage Rules for Television and Film Video: (i) tablet computers are treated as personal computers; (ii) “compatible mobile phones” may be expanded by Microsoft to include additional devices; and (iii) not all Authorized Devices are capable of receiving both streaming and downloads of video content.
    • Rules for video offered on a limited, time-based, video-on-demand basis (“VOD Content”)
      • VOD Content may only be viewed and privately displayed in your account region for personal, non-commercial purposes only via an Authorized Device during the VOD Viewing Period.
      • This limited, personal, non-exclusive, non-transferable right and license is subject to the Terms of Use, these Usage Rules, and is effective on payment of the required fees.
      • VOD Viewing Period: Either (i) fourteen (14) days from the date and time of your order or (ii) forty-eight hours (48) from the start of its initial playing, whichever occurs first, or as otherwise specified at the time of purchase.
      • Upon the expiration of the VOD Viewing Period, you will no longer be able to view the VOD Content without obtaining an additional license.
      • VOD Content directly downloaded to an Authorized Device may only be viewed on that device; except VOD Content downloaded to a personal computer may be copied from that personal computer to, and viewed on, a compatible mobile phone (or where authorized by the Services, a Zune) prior to playback on such personal computer. Once you have copied an item of VOD Content to a Zune or compatible mobile phone, you will not be able to view it on the PC it was copied from.
      • To stream VOD Content to an Authorized Device, you must be logged into the Services. Where authorized by the Services you may stream an item of VOD Content to more than one Authorized Device during the VOD Viewing Period; provided, however, that you may only stream an item of VOD Content to one Authorized Device at a time.
      • Once you have downloaded an item of VOD Content from the Services on one Authorized Device, you will not be authorized to stream or download it from the Services to another device.
      • Unless otherwise authorized on this site or in the Terms of Use, you may not copy or move the VOD content from its originally stored location.
    • Rules for video offered on a retained license basis (“Retained Rights Content”)

      • Retained Rights Content may only be viewed and privately displayed in your account region for personal, non-commercial purposes only via Authorized Devices.
      • This limited, personal, non-exclusive, non-transferable right and license is subject to the Terms of Use, these Usage Rules, and is effective on payment of the required fees.
      • Personal Computers: You may only download or stream an item of Retained Rights Content from the Services to up to five (5) personal computers.
      • Xbox consoles:
        • After downloading Retained Rights Content to a download-capable Xbox console, you will be able to view the content on that console without logging into the service. You will also be able to download the Retained Rights Content onto a second download-capable Xbox console, but you must remain logged into the Services to view the content on that second console. You may not copy or move the content from the second console.
        • You may only be logged into the Services via one Xbox console at a time.
      • Zunes or other compatible mobile phones:
        • Where authorized by the Services, you may download or stream an item of Retained Rights Content from the Service to up to three (3) compatible mobile phones. Retained Rights Content downloaded to a personal computer may be copied from that computer to, and viewed on, a compatible mobile phone (or where authorized by the Service, a Zune) to which such personal computer has been paired. Once you have copied Retained Rights Content to a Zune or compatible mobile phone, you may still view it on the PC it was copied from. Each Zune or compatible mobile phone may be paired to only one (1) PC. If you change that pairing relationship to a different PC, Retained Rights Content may be erased or rendered unplayable from such Zune or compatible mobile phone unless such PC also has a retained rights license to such Retained Rights Content.
      • Unless otherwise authorized on this site or in the Terms of Use, you may not copy or move the Retained Rights Content from its originally stored location.
      • Streaming:
        • To stream Retained Rights Content to an Authorized Device you must be logged into the Services.
        • You may only stream an item of Retained Rights Content to one Authorized Device at a time.
        • You may stream up to three (3) different items of Retained Rights Content at any one time to Authorized Devices through the same account.
      • Season Pass. In some countries, we may offer Season Pass which includes currently available and future episodes of a TV program season. If our agreements with the content owners cause us to deliver fewer episodes than planned at the time of your Season Pass purchase, we will give you a refund corresponding to the missing TV episodes on a pro-rata basis.
