Xbox LIVE Usage Rules

Unless otherwise stated, capitalized terms shall have the same meanings as the Terms of Use (“Terms of Use”) for the Service.

Any reproduction, redistribution, transmission, display, sale, broadcast, public performance, rental or lending, modification, adaptation, sub-license or other use of the content provided through the Service, except as otherwise expressly permitted in the Terms of Use, this usage rules site, or by copyright law, is expressly prohibited without the prior written consent of the copyright owner.

Xbox Music Pass Subscription. If available in your territory, you can choose to sign up for a Xbox Music Pass subscription, which allows you to stream or download from the Service in your territory as many songs as you want on a subscription basis for a flat monthly fee. As long as you continue to pay your subscription fee for the corresponding period, you will have access to all music content that is made available from the Service in your territory on a subscription basis. If you do not pay your subscription fee or your Xbox Music Pass subscription terminates for any other reason, you will no longer have access to any content you downloaded under your Xbox Music Pass subscription. Since the availability and content of Xbox Music Pass is specific to each country, if you change your territory, this will end your access to subscription content available in that territory. If you choose to end your subscription, or it otherwise terminates for any reason, you will not be able to play or access any subscription content that you have downloaded. Any unredeemed song credits will also expire.

Xbox Music Pass Subscription Content Usage Rules. Xbox Music Pass is available for your personal and non-commercial use only. You may only stream content to one personal computer, Xbox 360 console, or Zune device or Windows Phone device (each a ”Portable Device”) at a time. With an Xbox Music Pass, you may download music content on a subscription basis in your territory in the following manner:

  • If you are a Xbox Music Pass user of the $14.99/month offer in the United States that includes 10 MP3 credits each month, you may download music on up to three (3) personal computers and up to three (3) Portable Devices.
  • For all other Xbox Music Pass users, you may download music on up to four (4) devices, including personal computers, and portable devices, so long as one is a personal computer.

You must sign into the Service at least once every 30 days to refresh the digital licenses that accompany each download of subscription content. If you have transferred subscription content to your Portable Device(s), you may need to connect the Portable Device(s) to your personal computer and log into the Service to refresh your Portable Device(s) at least monthly or you may lose your access to such content.

You cannot burn subscription content and/or playlists containing subscription content to CD. However, you can separately purchase music content from the Service under the terms listed below in this Section. Any purchased content would not expire when your subscription ends.

Non-Commercial Use. Music and video content may only be used for personal, non-commercial use and may not be used as a musical "ringer" or ringtone for a mobile phone without the prior written consent of the copyright owner.

Usage Rules for Sound Recordings. For DRM-protected sound recordings, you are authorized to use the content that you purchased from the Service in your territory on up to five (5) personal computers and as many Portable Devices as are reasonably necessary for your personal and non-commercial use. You may transfer the license to another device or personal computer at any time, so long as your total number of personal computers does not exceed five (5). You are entitled to burn purchased content, and playlists containing purchased content, to CD solely for personal, non-commercial use. There is no limit to the number of times you can burn an individual song; however, you may only burn the exact same playlist a maximum of seven (7) times.

For DRM-free sound recordings, you are authorized to make only such copies as are reasonably necessary for your personal and non-commercial use, and any other copying in excess of that is expressly prohibited and may constitute copyright infringement.

Content Usage Rules for Music and Music Videos. All music and music video content you purchase, rent or acquire on a subscription basis from the Xbox Music Service in your Territory is subject to Terms of Use and any other applicable terms and conditions. These include: (i) limitations imposed by copyright owners; and (ii) use of digital rights management (DRM) technology.

You are authorized to use the content you purchased from the Service in your territory on up to five (5) personal computers and/or Xbox 360 consoles in any combination (e.g., 3 personal computers and 2 Xbox consoles), and as many Portable Devices as are reasonably necessary for your personal and non-commercial use. If you purchase content from the Service on a personal computer as part of a promotional bundle, you may not be able to re-download it to Xbox 360 consoles.

Storage. Any burning or exporting capabilities (if applicable) are solely an accommodation to you. They do not constitute a grant or waiver (or other limitation or implication) of any rights of the copyright owners of any audio or video content, sound recording, underlying musical composition or artwork embodied in any purchased content.

Usage Rules for Video Content (Film or Television). We may offer video content in your Territory ("Video Content") for download, streaming or both, on: (i) a limited time-based video-on-demand basis ("VOD Content"); or (ii) a retained license basis ("Retained Rights Content"). You may only stream Video Content to the extent this feature is authorized under the Service. Resolution of Video Content purchased in high definition may vary depending on the content you chose, the device or hardware that you use, and the bandwidth of your Internet connection. To the extent that the terms contained in any other sections of this contract conflict with the Terms of Use, the terms listed on this site control with respect to any license you obtain for video content.

VOD Content. Notwithstanding anything to the contrary in this contract, we grant you a personal, non-exclusive, non-transferable, limited right and license to view and privately display the VOD Content in your Territory for personal, non-commercial purposes only via an Authorized Device. This limited right and license is subject to the terms of the Terms of Use, the Usage Rules and is effective on payment of the required fees.

The initial license to each item of Video on Demand (“VOD”) content is limited in its term and duration to fourteen (14) days from the date and time of your order or twenty-four (24) hours from the start of its initial display and viewing, whichever occurs first, unless otherwise specified as being limited to different term or duration at the time of purchase (the “VOD viewing time”). VOD content can only be displayed and viewed on the Authorized Device you initially downloaded or streamed to; however, you may display and view VOD content downloaded to your personal computer on one Portable Device. Once you choose to display and view VOD content on your Portable Device downloaded from your personal computer, you cannot view such content on your personal computer. To stream VOD content you must be logged into the Service. Upon the expiration of the VOD viewing time, you will no longer be able to view the VOD content without obtaining an additional license. Unless otherwise authorized on this site or in the Terms of Use, you may not copy or move the VOD content from its originally stored location.

Retained Rights Content.  Notwithstanding anything to the contrary in this contract, we grant you, a personal, non-exclusive, non-transferable, limited right and license to view and privately display any Retained Rights Content you obtain via the Service in your Territory. This limited right and license is: (i) subject to the terms of this contract; (ii) for personal, non-commercial purposes only, for and during your authorized use of the Xbox Music Service; and (iii) effective on payment of the required fees. Once you obtain a license to an item of Retained Rights Content, you may download or stream a copy of it to one or more Authorized Devices, as set forth on this site.

Once a license to an item of retained rights content is obtained, you may download or stream a copy of such retained rights content to one or more Authorized Devices, as set forth below and as authorized in the Service:

(i) Personal Computers: You may download an item of retained rights content from the Service on up to four (4) personal computers.

(ii) Xbox 360 consoles: Retained rights content may be downloaded to an initiating Xbox 360 console. Retained rights content downloaded from the Service to an initiating Xbox 360 console may be displayed and viewed on such initiating Xbox 360 console regardless of whether you are logged into the Service. You may not copy or move the retained rights content from its originally stored location, but you may download any previously obtained retained rights content to an additional Xbox 360 console (a “Roaming Xbox Console”) (including downloading to a removable hard drive on the initiating Xbox 360 console and transferring such hard drive to a Roaming Xbox Console) for viewing on such Roaming Xbox Console, provided you are logged into the Service and follow any further instructions we may provide to authenticate the Roaming Xbox Console. After verification that you have previously purchased the retained rights content via the Service, you may download such content on the Roaming Xbox Console, provided you remain logged into the Service. You may not copy or move the retained rights content from a Roaming Xbox Console. You can only be logged into the Service via one Xbox 360 console at a time.

(iii) Portable Devices: To access retained rights content downloaded to a personal computer from the Service on your Portable Devices, you must create a sync relationship between your Portable Devices and such personal computer. If you attempt to create a sync relationship between a Portable Device and a different personal computer, you will erase all retained rights content that is not licensed on the new personal computer from such Portable Device. You are not authorized to copy retained rights content from one Portable Device to another Portable Device.

(iv) Streaming: To stream retained rights content to an Authorized Device you must be logged into the Service. Each item of retained rights content may be streamed to a personal computer or an Xbox 360 console, provided that it can only be streamed to one device at a time. You may stream up to three (3) different items of content at any one time through the same account.

Season Pass. In some countries, we may offer Season Pass which includes currently available and future episodes of a TV program season. If our agreements with the content owners cause us to deliver fewer episodes than planned at the time of your Season Pass purchase, we will give you the amount of Points corresponding to the missing TV episodes on a pro-rata basis.
