By accessing a 1 vs 100 (beta) Season
1 Live Show, you are agreeing to participate in the “1 vs 100 (beta)
Season 1 Live: Season 1 Challenge” (the “Challenge”) and to abide
by these Official Rules (“Official Rules”), the 1 vs 100 (beta)
Season 1 Live in-game “How to Play” instructions (“Game Play Instructions”),
the Xbox LIVE Terms of Use, any other terms and conditions referenced
in the Official Rules, and the decisions of Microsoft Limited, the promoter
of this Challenge.
If there is a conflict between these
Official Rules, the Game Play Instructions, the Xbox LIVE Terms of Use,
or any other terms and conditions referenced in these Official Rules,
these Official Rules shall control in relation to the Challenge.
If you do not agree with these Official
Rules, please do not access a 1 vs 100 (beta) Season 1 Live Show or
otherwise participate in this Challenge.
COMMON TERMS USED IN THESE RULES:
In these Official Rules, "we,"
"our," and "us" refer to Microsoft Corporation,
the sponsor of the Challenge; and "you” refers to an eligible
Challenge entrant.
OVERVIEW:
The Challenge starts at 00:00:01 A.M.
GMT on 10/07/09, and ends 11:59:59 P.M. GMT on 30/08/09 ("Season
1").
Season 1 will consist of separate 1
vs 100 (beta) Season 1 Extended Play (each, an “Extended Play Show”)
and 1 vs 100 (beta) Season 1 Live Shows (each, a “Live Show”), offered
on an ongoing basis throughout Season 1.
Each Live Show will be approximately
two (2) hours in duration and will operate as follows.
Each Live Show will consists of
consecutive rounds of skill-based 1 vs 100 (beta) Season 1 gameplay
(each, a “Round”). Prior to each new Round, the roles of The
One and The Mob will be determined as described below, and The One and
The Mob will compete against one another by answering trivia questions
in the 1 vs 100 (beta) Season 1 gameplay format. A Round will
continue until either a) The One outlasts all members of the The Mob;
b) The One opts to ‘Take the Microsoft Points,’; or c) The Mob outlasts
The One, or d) all participants (i.e., The One and The Mob) answer incorrectly
and are eliminated; chance plays no part in winner determination.
It is estimated that each Live
Show will consist of approximately ten (10) separate Rounds of 1 vs
100 (beta) Season 1 Live gameplay, but the number of Rounds ultimately
depends on the relative skill of the participants.
We will not start a new Round during
a Live Show when there are fewer than one hundred and two (102) players
in the game lobby, or when there are fewer than ten (10) minutes remaining
during a Live Show.
During each Round, while The One
and members of The Mob are competing against one another in the 1 vs
100 (beta) Season 1 Game, members of The Mob and The Crowd will also
be competing against in the “Top 3 Scoring Game.” At the end of
each Round, the three (3) players with the highest scores (as determined
based on the criteria described below) will win prizes as described
below.

A LIVE SHOW AND WIN PRIZES IN THIS CHALLENGE IF YOU MEET THE ELIGIBILITY
AND SYSTEM REQUIREMENTS DESCRIBED BELOW AT THE TIME YOU ACCESS A LIVE
SHOW. ACCESSING OR PARTICIPATING IN
A LIVE SHOW DOES NOT GUARANTEE THAT YOU ARE ELIGIBLE TO
WIN PRIZES.

YOU ARE NOT ELIGIBLE TO WIN PRIZES
IN THIS CHALLENGE IF YOU ACCESS A LIVE SHOW AS A GUEST OF AN XBOX LIVE
GOLD SUBSCRIBER.
YOU ARE NOT ELIGIBLE TO WIN PRIZES
IN THIS CHALLENGE IF, VIA A FRIEND INVITE, YOU ACCESS A LIVE SHOW DESIGNATED
FOR A DIFFERENT REGION AND YOU ARE NOT A LEGAL RESIDENT OF THAT REGION.
FOR EXAMPLE, IF YOU ARE A LEGAL RESIDENT OF CANADA, AND YOU ACCEPT A
FRIEND INVITE TO PLAY IN A LIVE SHOW DESIGNATED FOR THE UNITED KINGDOM,
THEN YOU ARE NOT ELIGIBLE TO WIN PRIZES IN THAT LIVE SHOW.
- You must be 12 years of
age or older at the time of entry in order to play the game
- If you are 18 years of age
or older, but are considered a minor in your place of residence, you
should ask your parent's or legal guardian's permission prior to participating
in this Challenge or any Live Show; and
- You are NOT an employee
of Microsoft Corporation or its affiliates; and
- You are
NOT involved in any part of the administration and execution of
1 vs 100 (beta) Season 1 Live or this Challenge; and
- You are NOT
a household member or immediate family member (parent, sibling, spouse,
child) of a Microsoft employee or a person involved in any part of the
administration and execution of 1 vs 100 (beta) Season 1 Live or this
Challenge.
WE RESERVE THE RIGHT TO VERIFY ALL
ELIGIBILITY, EVEN AFTER THE CONCLUSION OF A ROUND,
A LIVE SHOW OR SEASON 1.
SYSTEM REQUIREMENTS:
To participate in the Challenge or
any Live Show or Round that is a part of the Challenge, you must verify
that you meet the following system requirements:
- you have access to an Xbox
360® video game and entertainment system with minimum 20GB hard drive
(minimum of 200MB space require (this may vary); and
- you have access to a broadband
internet connection; and
- you are an Xbox LIVE Gold
member in good standing.
Please note that normal internet access
and usage charges imposed by your online service will apply.
DETERMINATION OF
‘THE ONE’, MEMBERS OF ‘THE MOB’ AND MEMBERS OF
‘THE CROWD’:
To participate in the Challenge, you
must first access a Live Show. Before each Round during a Live
Show, we will determine the roles of “The One”, “The Mob” and
“The Crowd” from among all players in the game lobby as more fully
described below. Players with Privacy Settings set to “Private”,
are not eligible for selection as The One or The Mob, and cannot win
prizes, even if they participate as a member of “The Crowd”.
Subject to the participation limits
for the role of “The One” described below, before each Round, we
will select the top player in the game lobby to compete as “The One”
based on a pre-designated and weighted combination of the following
skill elements:
- Participation: How many
questions you answer
- Speed: How quickly you answer
questions
- Accuracy: How well you answer
questions
After we determine your score for
each skill element described above, we will determine whether you are
the top player by applying one of the pre-designated and weighted combinations
of skill elements below.
- Skill Combination 1:
Participation, then Speed
- Skill Combination 2:
Speed, then Accuracy
- Skill Combination 3:
Accuracy, then Speed
For example, during Round 1 of
a Live Show, we will determine whether you are the top player by combining
your Participation and Speed scores, with extra emphasis on your Participation
score. During Round 2 we will determine whether you are the top player
by combining your Speed and Accuracy scores, with extra emphasis on
your Speed score.
In the event
of a tie, we will break the tie using your time of arrival to the game
lobby.
Limit one (1) opportunity to compete
as “The One” during Season 1 per person and Xbox LIVE Gamertag.
In the unlikely event that all players in the game lobby prior to a
given Round have already competed as “The One”, we may relax the
foregoing gameplay limitation, and the top scorer will compete as The
One.
After selection of The One as described
above, and subject to the participation limits described below, before
each Round, we will select the top one hundred (100) players in the
game lobby to compete as a member of ‘The Mob’ based on the same
skill criteria used to determine The One, as described above.
Limit one (1) opportunity to compete
as a member of “The Mob” per Live Show per person and Xbox LIVE
Gamertag. In the unlikely event that all players in the game lobby
prior to a given Round have already competed as a member of “The Mob”
we may relax the foregoing gameplay limitation.
Players who are not selected as
The One or The Mob, or who access a 100 Live Show after the start of
a Round, will participate in the Live Show as members of ‘The Crowd’.
If we determine that you are attempting
to exceed the gameplay limits described above by any means, including
without limitation, use of multiple Xbox LIVE accounts and/or identities,
you will forfeit any prizes and we will automatically disqualify you
from this Challenge and we may also disqualify you from participating
in other promotions we offer.
Microsoft assumes no responsibility
for any computer, online telephone, internet connectivity, or technical
malfunctions that may occur during selection of The One or The Mob,
or The Crowd, or whilst the game is in progress
GAMEPLAY:
1 vs 100 (beta) Season 1
Live Game
The One and members of The Mob will
compete against one another in the “1 vs 100 (beta) Season 1 Live
Game” for one (1) Round during a Live Show by answering trivia questions
in the 1 vs 100 (beta) Season 1 gameplay format as more fully described
in the Gameplay Instructions (see in-game “How to Play” panel under
“Settings”)
After The One reaches Prizing Tier
2 (at least 10 Mob members eliminated), our live host (“The Host”)
will offer The One the opportunity to “Take the Microsoft Points.”
(in game referenced as ‘Money or Mob’) If The One opts to
continue competing against The Mob, The One will forfeit the designated
prize for Prizing Tier 1, and The One will not be offered the opportunity
to “Take the Microsoft Points” again until he or she either reaches
the next Prizing Tier or correctly answers the next three (3) questions.
A Round will continue until either
a) The Mob outlasts The One, b) The One opts to “Take the Microsoft
Points,” c) The One outlasts all members of The Mob, or d) all participants
answer incorrectly and are eliminated. At the conclusion of the
Round, all players will automatically return to the game lobby, and
new players will be selected for the role of The One, The Mob and The
Crowd as described above.
In the unlikely event The One incorrectly
answers one of the first three (3) questions, he or she will be forced
to make a second attempt at answering the question using one of the
following ‘in-game’ helps. If The One uses an in-game help
and still incorrectly answers one of the first three (3) questions,
The Round will end, no prizes will be awarded to The One, or to anyone
in The Mob or The Crowd, and a new One, Mob and Crowd will be determined
as described above.

Top 3
Scoring Game
During each Round of a Show, while
The One and members of The Mob are competing against one another in
the 1 vs 100 (beta) Season 1 Live Game, members of The Mob and The Crowd
will also be competing in the “Top 3 Scoring Game”. The One
is not eligible to compete in the Top 3 Scoring Game.
PLEASE NOTE: Even if you are in ‘The
Crowd’ if your Privacy Settings are set to “Private” you
are not eligible to win prizes in the Top 3 Scoring Game.
At the end of each Show, the players
with the top three (3) scores, based on the scoring mechanism described
below, will be named Top 3 Scoring Game prize winners UNLESS
The One did not answer at least four (4) questions.
- Question
Value: 500 points for each correct answer received.
- Speed:
- 200 points for each answer
received before time expires.
- 100 points for each correct
answer received within 750 milliseconds of question.
- Streak:
A “Streak Bonus” is awarded for correctly answering a series
of questions. An incorrect answer resets the streak bonus to zero.
- Mob Knockouts:
Points for each member of The Mob you outlast. You can earn anywhere
from 10 to 500 points per member of The Mob you outlast, depending on
the then current Prizing Tier detailed in the tables below.
CODE OF CONDUCT:
Anyone competing in
an unsportsmanlike manner or in a manner that is not in compliance with
these Official Rules may be immediately disqualified from the Round,
this Challenge and other promotions that we offer. Unsportsmanlike
conduct includes, but is not limited to, the following violations:
Unsportsmanlike
conduct (voice)
- Swearing or threats
- Spamming or screaming
- Harassment
- Lewdness
- Using any device to create
loud sounds
- Any other type of conduct
deemed inappropriate
Unsportsmanlike
conduct (gameplay)
- Cheating of any sort through
various means
- Continuous pauses during
the gameplay
- Delaying or slowing gameplay
using various tactics
- Intentionally disconnecting
the network cable
- Intentionally interrupting
network connectivity, other bug injection or unauthorized methods of
affecting gameplay
- Any other known or unknown
way of tampering with gameplay, including collusion with other players

The prizes listed in the table above
are awarded to The One when The One answers questions correctly, yet
the requisite number of Mob members fail to answer correctly (and are
therefore eliminated). Conversely, the prizes listed in the table
above will be awarded to those members of The Mob who answer questions
correctly when The One fails to answer correctly. All of the above prizes
are non transferrable and will be redeemed by email.
The table below is only applicable
to an individual playing as The One who knocks out the ENTIRE Mob, they
will receive 10,000MS points (as above) PLUS an additional physical
prize (up to a maximum of 2 physical prizes per weekly show which will
be allocated on a first come fist served basis).

PRIZE LIMITS
Regardless of whether you qualify to
participate as The One, or as a member of The Mob or of The Crowd, or
whether you participate in the 1 vs 100 (beta) Season 1 Live Game or
The Top 3 Scoring Game, THERE IS A STRICT LIMIT OF THREE (3) TOTAL
PRIZES PER PERSON PER SEASON.
In addition, Microsoft has an allocated
number of physical prizes for each week, as detailed in the table above,
and once these have been won, the only prizes available for beating
the Mob will be MS points. For the avoidance of doubt physical
prizes are only awarded if the One beats the entire Mob.
PRIZE CONDITIONS
If for any reason an advertised prize
is unavailable, we reserve the right to substitute a prize of equal
or greater value as permitted.
If you are selected as a potential
prize winner:
- You may not exchange your
prize for cash or any other merchandise or services; and
- You may not designate someone
else as the winner. If you are unable or unwilling to accept your prize,
you will forfeit your prize; and
- If you accept a prize, you
will be solely responsible for all applicable taxes related to accepting
the prize; and
- If you meet the eligibility
criteria set forth in the “Can I Enter” section of the Official
Rules above, but you are considered a minor in your place of residence,
we may award the prize to your parent/legal guardian on your behalf;
and
- Unless otherwise noted,
all prizes are subject to their manufacturer's warranty and / or terms
and conditions as applicable in their country of origin.

awarded within 28 days of verification (see below);

IF YOU ARE SELECTED AS THE ONE AND
WIN AN ADDITIONAL PHYSICAL PRIZE BY BEATING THE MOB, YOU MUST REPLY
TO OUR EMAIL NOTIFICATION WITHIN FOURTEEN (14) DAYS WITH YOUR CONTACT
DETAILS AND A SUITABLE TIME FOR US TO CONDUCT A VERIFICATION CALL. All
physical prizes must be signed for by the winner.
Please make sure that your Xbox LIVE

If you fail to keep your
Xbox LIVE account information current, you may forfeit your prize.
If you fail to provide accurate Xbox LIVE account information regarding

and password, and then select "Sign In".
- E-mail address is located

If the in-dash notification that we
send is returned as undeliverable, or you are otherwise unreachable
for any reason, you will forfeit the prize in its entirety.
YOU ARE NOT THE WINNER OF ANY PRIZE,
EVEN IF THE EMAIL MESSAGE YOU RECEIVE INDICATES OTHERWISE, UNLESS AND

1 Live Show , you agree:
- To abide by these Official
Rules for the Challenge; and
- To release and hold harmless
Microsoft and their respective parents, subsidiaries, affiliates, employees
and agents from any and all liability or any injury, loss or damage
of any kind arising from or in connection with this Challenge, or any
prize won, including without limitation the following:
- Lost, late, incomplete,
inaccurate, stolen, fraudulent, misdirected, undelivered, interrupted,
damaged, or delayed reports or other information; or
- Any incorrect or inaccurate
information or error or defect of any kind regardless of who it is caused
by, or the means by which it occurred; or
- Equipment, software, network
or systems that fail, have viruses or other problems, are breached or
that cause injury or damage to participants or their property.
- Microsoft cannot guarantee
the performance of any third party and shall not be liable for any act
or default by a third party. Participants in this promotion
agree that Microsoft will have no liability whatsoever for any injuries,
losses, costs, damage or disappointment of any kind resulting in whole
or in part, directly or indirectly from acceptance, misuse or use of
a prize, or from participation in this promotion.
- Nothing in this clause shall
limit Microsoft’s liability in respect of death or personal injury
arising out of its own negligence or arising out of fraud.
- That Microsoft's decisions
will be final and binding on all matters related to the Challenge;
and
- That by accepting a prize,
Microsoft may use of your name, gamertag, avatar, information, and state
of residence online and in print, or in any other media, in connection
with the advertising and marketing of this Challenge in any and all
media, without payment or compensation to you, except where prohibited
by law
- and acknowledge that your
ability to play 1 vs 100 (beta) Season 1 is dependent upon your internet
connection and since Microsoft cannot control the service level or the
agreement you as a consumer have with your ISP, as such Microsoft cannot
be held responsible for the game becoming unstable, or dropping connectivity
due to any potential network connectivity restrictions, or latency which
may occur.

WHAT LAWS GOVERN THE WAY THIS
CHALLENGE IS EXECUTED AND ADMINISTRATED?
This Challenge is governed by the laws
of the country in which the Challenge is administered, and you consent
to the exclusive jurisdiction and venue of the courts of said country
for any disputes arising out of this Challenge.
WHAT IF SOMETHING UNEXPECTED HAPPENS
AND THE CHALLENGE CAN'T RUN AS PLANNED?
If cheating, a virus, bug, catastrophic
event, or any other unforeseen or unexpected event that cannot be reasonably
anticipated or controlled (also referred to as force majeure) affects
the fairness and / or integrity of this Challenge, we reserve the right
to cancel, change or suspend the Challenge. This right is reserved whether
the event is due to human or technical error. If a solution cannot be
found to restore the integrity of the Challenge, or any Round or Show
that is part of the Challenge, we reserve the right to withdraw or modify
the Challenge, or the applicable Show or Round.
If you attempt to compromise the integrity
or the legitimate operation of this Challenge by hacking or by cheating
or committing fraud in any way, we may seek damages from you to the
fullest extent permitted by law. Further, we may ban you from participating
in the Challenge and any of our future so promotions, so please play
fairly.
HOW CAN I FIND OUT WHO WON?
We will post lists of the gamertags
of winners receiving prizes online at www.xbox.com/1vs100 within two weeks of those individuals’ winning.
Each of these winner lists will remain posted for at least 30 days but
no more than 90 days.
