This competition is open to residents of the United Kingdom, Austria, Belgium, Denmark, Finland, France, Ireland, Italy, Netherlands, Norway, Spain, Sweden, Switzerland, 18 years and older, except employees of Microsoft Limited and their respective subsidiaries, affiliates, advertising and promotion agencies and their immediate families (defined for the purpose of these rules as husband, wife, mother, father, sister, brother, son, daughter, or persons residing in the household of such employees), and anyone else professionally connected with this competition. The promoter reserves the right to verify the eligibility of entrants and check their identity.

To be eligible to win the prize, entrants must design a monster inspired by the Locust Horde as featured in Gears of War (“Entry”) and send their Entry to xboxwins@xbox.com. The competition will launch at 9.00am GMT on October 6 2006 and run until 5.00pm GMT on October 20 2006.
In consideration of the promoter making the competition available to you, you hereby irrevocably and unconditionally (i) grant to the promoter and its assignees and licensees all consents which are or may be required under Part II of the Copyright, Designs and Patents Act 1988 and any statutory modifications or re-enactment thereof for the exploitation of the Entry, through the universe, in perpetuity, by any and all means and in any and all media now or hereafter known or devised; (ii) assign to the promoter free of all charges, encumbrances and rights exercisable by third parties and, without prejudice to the foregoing, with full title guarantee and where the assignment is of copyright or performers' property rights, by way of an assignment of present and future copyright or performers' property rights, all right, title and interest of whatsoever nature (including, without limitation, all copyright and performers' property rights) throughout the universe, whether vested or contingent, in and to the Entry, for the promoter to hold the same absolutely for the full period of those rights wherever subsisting or acquired, including all renewals, reversions, revivals and extensions and thereafter (insofar as may be or become possible) in perpetuity; and (iii) waive in perpetuity in respect of the Entry the benefits of any provision of law known as moral rights or any similar law in any country. You warrant and represent that your Entry is original to you and not obscene or defamatory and that you have the right to grant the consents and assign the rights expressed to be granted in this clause 4, free from encumbrances and third party rights. You agree to indemnify the promoter from and against any loss, claim, liability, damage, action or cause of action brought against promoter by a third party and arising from or related to any material contained within the Entry, or a breach by you of the foregoing warranty and representation.
Entries that are incomplete, defaced or damaged will be deemed invalid. No responsibility will be accepted for Entries lost, delayed or damaged in transmission.
The winner will be the determined on creative merit and originality of design by the final judging panel on October 23. The judging panel will consist of two representatives from Xbox EMEA.
The judges’ decision is final and no correspondence will be entered into.
The prize, one per country, will consist of a trip to the development studio of Epic Games in Raleigh, North Carolina, USA. Value: 1220 Euro. No cash alternatives.
Details of the prize winners may be obtained by sending a self-addressed stamped envelope to Gears of War Locust Horde Competition at the address given below, after November 1, 2006.
The prize winners will be notified by email. The prize winners may be required to participate in publicity connected with this competition.
The collection of personally identifiable information for the purposes of this competition will be subject to the Xbox.com Privacy Statement at http://www.xbox.com/en-GB/legal/privacystatement.htm Specifically, the data collected through this competition will be used to send an email to entrants to confirm whether the entrant has won a prize or not. All personally identifiable information will be deleted approximately six (6) weeks after the winners are selected. By entering this competition, you expressly consent to the use of your personally identifiable information in accordance with the Xbox.com Privacy Statement.
These terms and conditions, the conduct of this competition and the interpretation and enforcement of these terms and conditions shall be exclusively governed and construed in accordance with the laws of England. Entrants irrevocably submit to the exclusive jurisdiction of the Courts of England and Wales.
