MICROSOFT XBOX – CANADA 150 CONTEST this contest is open to RESIDENTS OF canada only and is GOVERNED by Canadian law

OFFICIAL RULES

The “XBOX Canada 150 Contest” (the “Contest”) is governed by these official rules (the “Official Rules”), which are available online at www.xbox.com/en-ca/promotions/Xbox-Canada-150-Contest from June 28, 2017 to July 7, 2017. By participating in the Contest, each entrant agrees to be legally bound by these Official Rules, including without limitation all eligibility requirements, and understands that the Sponsor’s (defined below) decisions about the Contest are final and binding in all respects. The Contest is subject to all federal, provincial and local laws and regulations and is void where prohibited by law.

1. SPONSOR:

This Contest is sponsored by Microsoft Canada Inc., 1950 Meadowvale Blvd, Mississauga ON L5N 8L9 (the “Sponsor”).

2. CONTEST PERIOD:

The entry period for the chance to win the Grand Prize (as described below) begins on June 28, 2017 at 12:01 AM Eastern Time (“ET”) and ends on July 7, 2017 at 11:59 PM ET (the “Contest Period”).

3. ELIGIBILITY, RESIDENCY AND AGE:

The Contest is only open to natural persons who (at the time of entry): (i) are residents of and are physically located in Canada; and (ii) have reached the legal age of majority in their province or territory of residence. Employees, representatives or agents (and those with whom such persons are living, whether related or not) of Sponsor or Contest Administrator, their subsidiaries, affiliates, associated companies, prize suppliers, advertising/contest agencies and any other individual or entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”) are not eligible to enter or win.

4. HOW TO ENTER:

To enter the Contest, perform the following acts on Facebook, Instagram or Twitter during the Contest Period. If an entrant agrees to be legally bound by the Official Rules, he/she must signify his/her acceptance and understanding of the Official Rules by checking the “Agree” checkbox where indicated. If an entrant does not agree to be legally bound by the Official Rules, then he/she will not be permitted to participate in this Contest. Once the Form is completed and submitted, eligible entrants can earn entries (“Entries”) into the Contest draw for the chance to win the Grand Prize can be earned as follows. Maximum four (4) Entries per person.

To earn Entries into the Contest:

FACEBOOK: To earn one (1) Entry, eligible entrants must click the “Like” button or comment on the Contest Launch post from Xbox Canada. Eligible entrants must have a public Facebook account and follow Xbox Canada on Facebook in order to Like or Comment. If an eligible entrant does not have a Facebook account, visit www.facebook.com to sign up. Once signed up, search for Xbox Canada in the search bar. Select the Xbox Canada Facebook page and click Like to Like their page. Once eligible entrants have Liked this page, they can then Like or comment on the Contest Launch post from Xbox Canada.

INSTAGRAM: To earn one (1) Entry, eligible entrants must share a photo on Instagram showcasing what you think makes Canadian gaming unique and use #XboxCAN150Contest in the post. Eligible entrants must have a public Instagram account and follow Xbox Canada on Instagram in order to qualify for an extra Entry. If an eligible entrant does not have an Instagram account, visit www.instagram.com to sign up. Once sign up, search for Xbox Canada. Select the Xbox Canada account and Follow their page. Once eligible entrants have followed the Xbox Canada Instagram account, they can then share a photo showcasing what they think makes Canadian gaming unique and use #XboxCAN150Contest in the post.

TWITTER (1): To earn one (1) Entry, eligible entrants must favourite or comment on ANY ORIGINAL Xbox content (does not include any content re-tweeted by Xbox). Eligible entrants must have a Twitter account in order to favourite or comment. If an eligible entrant does not have a Twitter account, visit www.twitter.com to sign up. Once signed up, search for Xbox Canada and scroll to find ANY ORIGINAL Xbox content and then favourite or comment on that tweet.

TWITTER (2): To earn one (1) Entry, eligible entrants must share a photo or text story of what makes Canadian gaming unique and use #XboxCAN150Contest in the tweet. Eligible entrants must have a Twitter account in order to tweet and follow Xbox Canada. If an eligible entrant does not have a Twitter account, visit www.twitter.com to sign up. Once signed up, search for Xbox Canada click on the Follow button. Once eligible entrants have followed the Xbox Canada Twitter account, they can then share a photo showcasing what they think makes Canadian gaming unique and use #XboxCAN150Contest in the post.

Incomplete Entries will be disqualified. All Entries become the sole property of the Sponsor and receipt of Entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, mutilated, invalid, unintelligible, or misdirected Entries; all such Entries will be disqualified. There is a limit of three (3) Entries per person, one Entry for each of the methods described above. For greater certainty, you can only use one (1) email address to enter, or otherwise participate in the Contest. If it is discovered that you have attempted to: (i) exceed any of the limits stated in the Official Rules; or (ii) use more than one (1) email address to enter, or otherwise participate in, the Contest then (in the sole and absolute discretion of the Sponsor), you may be disqualified from the Contest and all your Entries are subject to disqualification by the Sponsor. Your Entry will be rejected if (in the sole and absolute discretion of the Sponsor) the entry form is not fully completed and submitted in accordance with these Official Rules.  Use of any automated, script, macro, robotic or other program(s) to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification by the Sponsor.

5. SPONSOR’S RIGHT TO VERIFY:

All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity, eligibility and/or compliance with any provision of these Official Rules (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion). The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s). All decisions of the Sponsor are final and binding.

6. PRIZES:

GRAND PRIZE: There are four (4) Grand Prizes available to be won consisting of one (1) Custom Canada 150 themed Xbox One S Console (brand new in box, including all wires, one (1) controller and manual) shipped to the stated address given during entry. Each Grand Prize has an approximate retail value of $400.00 CAD (not including taxes). Console design will be randomly selected by Sponsor.

The Grand Prize and Secondary Prize must be accepted as awarded. The Grand Prize and Secondary Prize are non-transferable, cannot be substituted for another prize, cannot be sold, and cannot be redeemed for cash. Notwithstanding the foregoing, Sponsor reserves the right (at its sole and absolute discretion) to substitute the Grand Prize or Secondary Prize, or any component thereof, for another prize of equal or greater value in the event the Grand Prize or Secondary Prize, or any component thereof, is unavailable or for any other reason whatsoever.

SECONDARY PRIZE: There are one hundred fifty (150) secondary prizes to be won consisting of one (1) custom Canada 150 themed controller shipped to the stated address given during entry. Each Secondary Prizes has an approximate retail value of $80.00 CAD (not including taxes).

7. PRIZE WINNER SELECTION:

A random draw will take place on Monday July 10, 2017 at approximately 12:00 PM ET in Toronto, Ontario from all eligible Entries received to select the potential Grand Prize winner. The odds of winning the Grand Prize will depend on the total number of eligible Entries received throughout the Contest Period.

8. NOTIFICATION AND CONFIRMATION OF PRIZE WINNER:

Potential winner will be contacted within three (3) business days of the draw by the Sponsor or its representatives. If the potential winner cannot be reached, does not accept the Grand Prize or fails to comply with these Official Rules and requirements within three (3) days of being contacted by the Sponsor or its representative (all as determined by Sponsor in its sole and absolute discretion), such potential winner will be disqualified and will forfeit all rights to the Grand Prize. Upon such forfeiture, no compensation will be given to such disqualified potential winner and Sponsor will have sole discretion to randomly select another winner from the remaining applicable Entries (and, in such event, the notification and confirmation provisions stated in these Official Rules will apply to such new potential winner, with the necessary amendments). It may take 6 to 8 weeks for prizing to arrive for winner.

Before being declared the Grand Prize winner, the potential winner will be required to correctly answer a mathematical skill-testing question, without aid or assistance, and will also be required to sign a Declaration of Eligibility, General Liability and Publicity Release pursuant to which the potential winner, among other things, accepts the Grand Prize as awarded and fully releases the Contest Parties and their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from all liability in connection with this Contest and the awarding and use or misuse of the Grand Prize.  Failure by a potential winner to sign such requested documents or failure by the winner to comply with any terms in these Official Rules (as determined by the Sponsor in its sole and absolute discretion) may disqualify such potential winner and, if disqualified, such winner will forfeit all rights to the Grand Prize. If a potential winner fails to correctly answer the skill-testing question, such potential winner will be deemed ineligible and will forfeit all rights to the Grand Prize. In the event of any such forfeiture, Sponsor will have sole discretion to randomly select another winner the remaining applicable Entries (and, in such event, the notification and confirmation provisions stated in these Official Rules will apply to such new potential winner, with the necessary amendments).

9. GENERAL CONDITIONS:

Without limiting the generality of any other provision of these Official Rules, by entering the Contest, each participant agree to indemnify, release and hold harmless the Released Parties from any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, participation in this Contest, or possession, acceptance and/or use or misuse of the Grand Prize (if applicable) or participation in any Contest-related activity and/or claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.

10. ADDITIONAL TERMS:

The Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, third party apps, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, which may occur in relation to this Contest including any injury or damage to an entrant’s or any other person's computer or mobile device related to or resulting from downloading any material connected to the Contest. The Released Parties are not responsible for any errors or omissions in printing or advertising this Contest. The Released Parties are not responsible for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due Contest related documents or prize notifications.

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest in accordance with the letter and spirit of these Official Rules. Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

Sponsor reserves the right, at its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Official Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules.  Sponsor, at its sole and absolute discretion, reserves the right to cancel, amend or suspend this Contest, or to amend these Official Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. Subject to all applicable Canadian federal, provincial and municipal laws and regulations, these Official Rules govern all aspects of the Contest and are binding on all participants. 

In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules or other statements contained in any Contest-related materials (including without limitation any advertising or promotional materials), the terms and conditions of these Official Rules shall prevail, govern and control.

Sponsor is not claiming ownership rights to any portion of your Contest entry (“Entry”). However, by submitting an Entry, where allowed by law, you are (i) granting Sponsor a non-exclusive, irrevocable, royalty-free, worldwide right and license to use all or a portion of your Entry in connection with Microsoft products in perpetuity for the purposes of featuring all or a portion of your Entry in connection with the marketing, sale or promotion of Microsoft products (including but not limited to internal and external sales meetings, conference presentations, tradeshows, and screenshots of the contest entries on websites and in press releases) in all media (now known or later developed) without compensation or credit for use of your Contest or Entry; and (ii) waiving any moral rights in all portions of the Entry.

This contest will be governed by the laws of the province of Ontario and the country of Canada. You consent to the exclusive jurisdiction and venue of the courts of the Province of Ontario for any disputes arising out of this Contest.

11. PRIVACY:

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy https://privacy.microsoft.com/en-gb/privacystatement. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
